Dropping the Murder2 charge would be a good start..... but I fear that he would be found guilty of that... but shouldn't be.

Judge still in chambers. No telling when he'll come back, said 10 minutes but it's been lnger than that.

There's some chatter among family. McBride's Aunt, Bernia Spinks, says her niece was a hard worker, not a partier. She worked through a temp company doing various jobs. Friends in the hall yesterday said McBide would have turned 20 in April and had big plans for a trip to Las Vegas.

all that could be true, but on that night, she wasn't her normal self. And how would a stranger, miles from the initial crash, know that?

Right... as far as Wafer was concerned there was somebody "invading" his home at 4AM... at the least an aggressive drunk banging on his doors... but he did not know that was all.

11:04 a.m. Turfe summarizing. Kesha performed autopsy, examined 5'4", 180-pound, 19-year-old female. She had no footwear, blood on her right hand, found pellets entered McBride's head right to left and front to back, said McBride was shot from within 3 feet, has .218 blood-alcohol level, shot straight on, couldn't determine brain injury but said it could have caused aggressiveness or other personality changes McBride had active alcohol and marijuana in her system.

11:06 a.m. Carmen Beasley testified she heard crash, saw McBride struck her car and was holing her head and wanted to go home, described her as confused, not combative.

11:10 a.m. Friends testified that Renisha was not combative or belligerent when drinking.

Turfe said for 2nd-degree murder malice or intent to kill is necessary.

"Defendant calls 911 dispatch, I just shot someone on my porch," Turf said. "Although the defendant didn't give his name he did give his address."

11:13 a.m. Turfe: both experts agreed the gun was pointed at McBride. All testimony indicated McBride wasn't combative, she may have injured her head, what we don't know is where she was from about 1:30 a.m. to her death at 4:42 a.m. The defense argues Self-defense Act.

"The defendant had the use of a peephole... What did he do in this case, he brought a shotgun to the door... He could have called fro help, he could have run to another part of the house... He Chose to shoot rather than not answer the door."

DETROIT, MI --
After two days of testimony, Dearborn Heights District Court Judge David D. Turfe ruled that there is enough evidence for Theodore Wafer, 54, of Dearborn Heights to face trial for the killing of Renisha McBride.

He is charged with second-degree murder, manslaughter and use of a firearm in the commission of a felony for the Nov. 2 killing.
