Spoke to her on phone 6 or 7 PM on the incident night and she was ok.

She was planning to visit his house around 9 PM

When reminded... he remembers he told cops she sounded drunk.... not very intoxicated.....

NOW he remembers she sounded so drunk he was worried....

Judge questions... prosecutor right to cross examine.... defence arguing this is in response to 911 call which is NOT the whole story.

Wafer statement was 2 hours later... Prosecutor say if SHE wanted to put this in she could... but its her prerogative.

OBVIOUSLY this statement clarifies things... this seems like a silly legal game... rather than a quest for the WHOLE TRUTH!!

One thing... when 911 operator called Wafer back... he advised him to come out via side door... and Wafer did that.
