CLEVELAND, Ohio –
The family of Tamir Rice hired the same attorney who represented the families of Michael Brown and Trayvon Martin.

Benjamin Crump appeared alongside Rice's mother Samaria Rice this morning on ABC's Good Morning America.

Crump is best known for representing the families of Brown, the unarmed suburban St. Louis, Missouri man shot to death by officer Darren Wilson, and Trayvon Martin, the unarmed Sanford, Florida teenager shot by neighborhood watchman George Zimmerman.

"Right now, the family is focused on getting justice for Tamir," Crump said during the interview while seated next to Rice.

The Rice family, along with Crump, appeared at an 11 a.m. news conference at the Olivet Institutional Baptist Church on Quincy Avenue in Cleveland.

The distraught older sister of 12-year-old Tamir Rice was tackled, handcuffed and held in the back of a police car in plain view of her grievously wounded brother, their mother claimed today.

Speaking for the first time since she buried her son, Samaria Rice also demanded indictments, trials and convictions for officers, Frank Garmback, 46 and Tim Loehmann, 26, who shot her son dead on November 22 in a Cleveland, Ohio park.

Speaking to ABC News, Samaria said that when she arrived at the park in a frantic state she saw her 14-year-old daughter languishing in the back of the same squad car that the officers arrived at the park in before the shot the boy dead.

'I couldn't believe they tackled her and put her in handcuffs and in the back of the same police car that was on the grass that the officer got out of and shot her brother so my daughter is sitting there looking at her brother on the ground,' Rice said this morning.

Having already filed a wrongful death suit, Samaria has said she wants both the officers to be held accountable for what they have done.

'I'm looking for a conviction for both of the officers,' she said to ABC News.

Her attorney is Benjamine Crump, who represented the parents of Michael Brown in Ferguson has said that the blame lies with the police.

Tamir Rice autopsy report released
WKYC Staff, WKYC 12:07 p.m. EST December 12, 2014

CLEVELAND -- 12-year-old Tamir Rice died from a gunshot wound to the torso with "injuries of major vessel, intestines and pelvis."

His autopsy report was released shortly after 11 a.m. Friday.

The report states the gunshot wound entered the left side of the abdomen.

The Cuyahoga County Medical Examiner's Office lists his death as a homicide.

The autopsy says Tamir was 5'7" and weighed 195 pounds.

Hearing scheduled for Friday morning in Tamir Rice lawsuit against city of Cleveland

CLEVELAND, Ohio – Attorneys who filed a lawsuit against the city of Cleveland for Tamir Rice's death – as well as the lawyer who will presumably replace them in the case – will make their first court appearance in the case Friday morning.

Attorneys Timothy Kucharski and David Malik filed a motion with U.S. District Chief Judge Solomon Oliver Jr. in December, asking him to let them off the case because Rice's mother, Samaria Rice, has not spoken to them for several weeks. Oliver is expected to do so during Friday's hearing.

Samaria Rice is now represented by Walter Madison, an Akron attorney, and Benjamin Crump, a Tallahassee, Florida attorney known for representing families of individuals whose deaths led to questions of racial bias.

The suit was filed Dec. 5, about two weeks after Rice, 12, was shot and killed by police Officer Timothy Loehmann at Cudell Recreation Center.

An extended version of a surveillance video shot at the recreation center, which was released Jan. 7, shows that that an officer cuffed Tamir's sister as she ran to check on her brother and that officers waited several minutes before administering first aid to the 12-year-old.

The city of Cleveland has until March 2 to respond to the suit.

CLEVELAND, Ohio -- The city of Cleveland on Friday responded to a lawsuit filed by the family of Tamir Rice with several defenses, including that the 12-year-old died and his family members suffered because of their own actions.

The city, in its response, wrote that Tamir's death on Nov. 22 and all of the injuries his family claims in the suit "were directly and proximately caused by their own acts, not this Defendant." It also says that the 12-year-old's shooting death was caused "by the failure ... to exercise due care to avoid injury."

The response does not explain these defenses in more detail, though 20 defenses are listed in all, including another one that says Tamir died because of "the conduct of individuals or entities other than Defendant."

I haven't watched any Cleveland either, Just saw the guy that will be there again streaming tonight..

something about stop the curfew....didn't even know they had a curfew there...lol

They have a curfew ? Why ? Is it enforced or are they being given room to destroy :roll . The protestors are a joke. Useful minions in the larger scheme of things, interchangeable from one grievance :cry to the next :cry .

Sadly they only seem to get more ignorant and abrasive with time.

thanks Molly, from what little I have seen on the case... the cops did what any cop would do I think...when ANY one is waving a gun around and not putting it down when cops tell you too..then there is going to be a problem....

still sad for a young boy to die..like that or any way...goes back to the parents teaching them right from wrong...

Between no indictment for Tamir Rice and pissed off for quashed protests on the Brello ruling Cleveland gonna be a hotspot this summer. Crump et al have been pushing Cleveland since beginning of May.

CLEVELAND, Ohio -- The family of Tamir Rice has released a statement in the wake of the Cuyahoga County Sheriff's investigation.

The statement is as follows:

    "We stand extremely vigilant with our effort to bring justice to Tamir-while we understand that the investigation into the shooting death of Tamir Rice by The two Cleveland Police Officers- Frank Garmback and Timothy Loehmann has now been handed over to the Prosecutor Tim McGinty for review -in addition to the hand over of the file, we have been made aware that the Prosecutor may soon convene a grand jury. In any case, we want the world to know we stand firm in our efforts. We (family) will not stop with our level of commitment to bring justice for Tamir, and with that in mind- we wish to ask the officials who are investigating Tamir's Case to be mindful and consider their sworn obligation and commitment to peace, social justice, and the civil rights of all." Earlier this week, the Cuyahoga County Sheriff's Department wrapped up its part of the investigation and handed its findings over to the Cuyahoga County Prosecutor's Office.

The prosecutor's office will decide whether charges should ultimately be filed.

WASHINGTON — Community leaders in Cleveland, distrustful of the criminal justice system, said Monday that they would not wait for prosecutors to decide whether to file charges against the police officers involved in the fatal shooting of 12-year-old Tamir Rice last year. Instead, they will invoke a seldom-used Ohio law and go directly to a judge to request murder charges against the officers.

The highly unusual move is the latest sign that some African-Americans in Cleveland and around the country have lost confidence in a system that they see as too quick to side with police officers accused of using excessive force against blacks.

Ohio is one of a handful of states that allow residents to request an arrest without approval from the police or prosecutors. It is difficult to know how the case will play out because there is little precedent for a citizen to request an arrest in such a contentious, high-profile case.

In cases involving police officers, prosecutors are more likely to let grand jurors hear conflicting testimony or see evidence favorable to the officer. Critics say that has established two standards for bringing charges: a high one for police officers, and a much lower one for everyone else.

A task force appointed by President Obama recommended in March that all cases involving the use of force by police officers be handled by independent prosecutors to “demonstrate the transparency to the public that can lead to mutual trust between community and law enforcement.” In the Cleveland case, however, Cuyahoga County prosecutors will decide whether to bring charges. Those prosecutors work regularly with Cleveland police officers, a closeness that activists have said is a conflict of interest.

Attorney for Tamir Rice’s family, Benjamin Crump, has taken a new strategy to gain success in his grievance claims.

  • In Sanford Florida 2012/2013 Benjamin Crump demanded prosecutor Angela Corey not use a Grand Jury. Crump won a victory in that regard getting George Zimmerman charged with murder and getting the case to jury trial; but lost the case when his fabricated claims were exposed in front of a trial jury. George Zimmerman was found not guilty.
  • In Ferguson, 2014, Benjamin Crump tried the same “anything to get to trial” approach by demanding prosecutor Robert McColloch again not use a grand jury. However, this time Ferguson/Saint Louis were wise to the strategy and Crump failed to pressure his demands.

    Again, as in 2012/13, another fraudulent case, this time against Police Officer Darren Wilson. The prosecutor didn’t bow, used the Grand Jury, and the Grand Jury found no cause.

  • In Cleveland, 2015, Benjamin Crump has refined his strategy. This time he doesn’t try to get the Prosecutor to comply with his demands – instead Crump asks a “Municipal Judge”, that does not usually handle such issues, to weigh in on the evidence of a police shooting of his client’s son, Tamir Rice.

    In essence Crump is trying to create pressure upon the Cleveland Grand Jury itself, to get to trial. He’s doing this by creating a narrative where a judge has already found ‘probable cause’ for the trial he demands.

    The goal is always to get to trial, because implied in the trial itself is an admission of wrongdoing on behalf of the defendant. That, “getting to trial” is all Benjamin Crump and Daryl Parks need to begin their civil liability extortion racket for “wrongful death” demands. Civil claims do not carry the same burden of proof for a criminal trial.
