Clinton sent classified material over email after leaving State Department

Hillary Clinton continued sending classified information even after leaving the State Department, The Post has exclusively learned.

On May 28, 2013, months after stepping down as secretary of state, Clinton sent an email to a group of diplomats and top aides about the “123 Deal” with the United Arab Emirates.

But the email, which was obtained by the Republican National Committee through a Freedom of Information Act request, was heavily redacted upon its release by the State Department because it contains classified information.

The markings on the email state it will be declassified on May 28, 2033, and that information in the note is being redacted because it contains “information regarding foreign governors” and because it contains “Foreign relations or foreign activities of the United States, including confidential sources.”

The email from Clinton was sent from the email account — hrod17@clintonemail.com — associated with her private email server.

The email’s recipients were Deputy Secretary of State William Burns, diplomat Jeffrey Feltman, policy aide Jake Sullivan, diplomat Kurt Campbell, State Department chief of staff Cheryl Mills, and Clinton aide Huma Abedin.

State Department ordered to hand over files on Abedin

A federal judge ordered the State Department on Monday to hand over all documents related to the employment status of Huma Abedin, former deputy chief of staff to Hillary Clinton, by the end of September.

But attorneys for the agency told the court Monday they had not yet found any related records among the materials provided this month by the FBI, raising the possibility that the State Department will have no personnel files to produce by its deadline.

The Freedom of Information Act lawsuit filed by conservative-leaning Judicial Watch sought documentation of the "special government employee" status given to Abedin in 2012.

Thanks to that rare designation, Abedin was able to collect paychecks from the State Department, the Clinton Foundation and a consulting firm called Teneo Strategies — all at the same time.

Hillary Clinton isn't immune from congressional impeachment proceedings just because she's out of office – and the Democrat could be subject to an impeachment inquiry even while she campaigns for the White House, a leading open government expert tells DailyMail.com.

Tom Fitton, president of the conservative open government group Judicial Watch, made the startling disclosure even as a leading House committee chairman have written the FBI seeking an investigation into whether Clinton committed perjury during testimony about her emails before a House Benghazi committee.

'One of the dirty little secrets in Washington is that Mrs. Clinton can be impeached now,' said Fitton in an interview. 'A federal official leaving office does not end congressional jurisdiction over impeachment for misconduct in that office.

'And if she was convicted by the Senate the sanction could be ineligibility for future office.'

Fitton is author of a new book, 'Clean House,' which is subtitled, 'Exposing our government's secrets and lies.'

Rick Perry calls on FBI director to resign over lack of Clinton indictment

Former Texas Gov. Rick Perry (R) on Wednesday called on FBI Director James Comey to resign over his recommendation not to press federal charges against Hillary Clinton for her use of a personal server while secretary of State.

The demand from Perry, who suggested Comey might have a political motivation for going soft on Clinton, the Democratic presidential nominee, is a step across a line that no other prominent Republican has so far been willing to take.

“For a man who prided himself on being a top law official in this country, I would suggest the man ought to resign,” the two-time presidential candidate and “Dancing with the Stars” contestant said on Fox News.

“Comey has a lot of explaining to do, because those of us who understand what was going on here — the Clintons were clearly trying to hide this server,” he said. “They did not want that information in, and for Comey to stand up and make excuses for Hillary is absolutely and totally unacceptable.

"I think [Comey] has some skin in the game here somewhere,” Perry said. “To protect the Clintons at this particular juncture is an extraordinary failure on his part.”

Comey is three years into a 10-year term as head of the FBI and is not scheduled to leave office until 2023.

New Emails Show Clinton Foundation Donors Lobbied Huma For Diplomatic Passports

New emails released by Judicial Watch in connection with its probe of the Bill, Hillary, and Chelsea Clinton Foundation indicate Clinton Foundation donors lobbied senior Hillary Clinton aide Huma Abedin for diplomatic passports.

Abedin responded positively to the donor inquiries, according to the email.

The donors in question include Doug Band and Justin Cooper. The email indicates that Band reached out to Abedin in 2009, when she served as deputy chief of staff at the U.S. Department of State, and asked for her help in obtaining diplomatic passports for him, Cooper, and a third individual identified only by their initials.

Anyone have an opinion on whether or not TheBeast will do a press conference before the election?

I would vote heck no.

IMO Hillary is never going to hold a press conference before the election.

She can’t afford to answer questions, she and her minions can plead the fifth and get all kinds of blackhearted deals from Comey and Lynch but if Clinton or her crew make public statements those statements are admissible in court. Look at the grief that her public lies about her emails has caused her.

I have thought that Team Clinton likely ran the scenario of how bad Hillary would come across during an uncontrolled press conference and how bad Hillary would look if she didn’t do a press conference and the “hiding Hillary” meme was more palatable to the public than the “answering questions Hillary.”

But I think that scenario is wrong. Or mostly wrong.

Hillary is silent because she is with all her power and privilege still terrified of facing accusations in a legal setting with her opposition being someone who is not in her pocket.

No wonder she looks like death warmed over a hot coal.

Though it was not their primary mission, FBI agents who investigated Hillary Clinton's email collected significant evidence suggesting she and her team violated federal record-keeping laws, including persisting to use a private Blackberry and server to conduct State Department business after being warned they posed legal and security risks, government sources tell Circa.The evidence was compelling enough to convince FBI Director James Comey that the Clinton team had not complied with record-keeping laws and to cause at least one witness to raise their Fifth Amendment right against self-incrimination during an investigative interview, the sources said.

In public, the FBI recommended not filing criminal charges against Clinton on national security grounds. But in private, the Bureau chose to defer to the State Department on whether to recommend anyone to the Justice Department for criminal prosecution on records law violations, the sources said, speaking only on condition of anonymity.

Each email transmission of a government document that was not preserved or turned over to the State Department from Mrs. Clinton's tenure could theoretically be considered a violation of the Federal Records Act, the main law governing preservation of government records and data.

Other federal laws make it a felony to intentionally conceal, remove or destroy federal records as defined under the Act, punishable with a fine and imprisonment of up to three years. A single conviction also carries a devastating impact for anyone looking to work again in government because the law declares that any violator "shall forfeit his office and be disqualified from holding any office under the United States."

The FBI "indirectly documented hundreds, and likely thousands, of violations of the Records Act," one source with direct knowledge of the FBI's investigation told Circa. Using forensics, the FBI recovered from computer drives and other witnesses about 15,000 emails from Mrs. Clinton's private account that dealt with government business, most that had not been turned over by her or her aides, the sources said.

State Dept will release Clinton's schedules before Election Day

The State Department will release all of Hillary Clinton's schedules from her days as secretary before Election Day, speeding up the expected time line officials gave last week.

All of Clinton's schedules of her meetings as secretary of State will be released before Nov. 8, The Associated Press reports.

The department has been releasing batches of Clinton's schedules since early this year following an order from a federal judge.

About half have been released so far.

The AP requested access to all of the schedules by Oct. 15. State Department lawyers told the news network last week that the last batch wouldn't be out until around Dec. 30.

The AP has been digging through Clinton's meetings with individuals from outside the government.

Bill Clinton's staff used a decades-old federal government program, originally created to keep former presidents out of the poorhouse, to subsidize his family’s foundation and an associated business, and to support his wife’s private email server, a POLITICO investigation has found.

Taxpayer cash was used to buy IT equipment — including servers — housed at the Clinton Foundation, and also to supplement the pay and benefits of several aides now at the center of the email and cash-for-access scandals dogging Hillary Clinton’s presidential campaign.

This investigation, which is based on records obtained from the General Services Administration through the Freedom of Information Act, does not reveal anything illegal. But it does offer fresh evidence of how the Clintons blurred the line between their nonprofit foundation, Hillary Clinton’s State Department, and the business dealings of Bill Clinton and the couple’s aides.

Hillary Clinton used at least eight different mobile devices to send private e-mail during her tenure as secretary of state -- none of which were recovered by the FBI as part of its investigation into her communications practices as the nation’s top diplomat.

The Federal Bureau of Investigation, in a heavily redacted summary of its probe released on Friday, said Clinton flouted security standards for official communications by relying on private e-mail for government business. The inquiry also found that former Secretary of State Colin Powell “warned Clinton that if it became ‘public’ that Clinton had a BlackBerry, and she used it to ‘do business,’ her e-mails could become ‘official record[s] and subject to the law.”’ He told her to be “very careful” using the system.

In addition to the eight devices she used as secretary of state, the FBI said there were at least five additional mobile devices they sought as part of their inquiry. Clinton’s lawyers said they could not provide any of the mobile devices she used. One person interviewed by the FBI said he recalled two instances in which Clinton’s devices were destroyed by “breaking them in half or hitting them with a hammer.”

The FBI released the summary Friday to shed light on its decision last month not to recommend prosecution of Clinton or her aides for using the private system. The Democratic presidential nominee was interviewed about her use of private e-mail by FBI agents and federal prosecutors for 3 1/2 hours on July 2. The bureau then recommended that the Justice Department not pursue criminal charges.
