Trial delayed for Enrique Marquez Jr., accused of supplying 2 guns in San Bernardino attack

The trial for Enrique Marquez Jr., the man accused of supplying two rifles used to kill 14 people in the San Bernardino terror attack, has been pushed back until this summer.

Marquez had been scheduled to go on trial on Feb. 23, but U.S. District Judge Jesus Bernal this week approved the postponement at the request of both prosecutors and defense attorneys, according to court papers.

Federal prosecutors and Marquez’s defense attorneys sought to postpone the trial until July 19, citing work on other cases and the “voluminous” evidence.

The request to postpone the trial, filed Jan. 29, said the case is “so unusual and so complex that it is unreasonable to expect adequate preparation” for a trial in late February.

He has pleaded not guilty to the charges filed against him. If convicted of all counts, Marquez faces up to 50 years in prison.

Three people linked to the couple whose December shooting rampage in San Bernardino left 14 people dead were arrested Thursday on conspiracy, marriage fraud and other charges.

The three include Syed Raheel Farook, the brother of Syed Rizwan Farook, who with his wife Tashfeen Malik also wounded 22 people before both died in a shootout with police.

Raheel Farook, 31, his wife Tatiana Farook, 31, and her sister Mariya Chernynk were named in a five-count indictment describing a scheme designed to allow Chernykh to remain in the U.S. Chernykh, 26, is married to Enrique Marquez, Jr., who has been awaiting trial since December on charges of conspiring with Rizwan Farook in 2011 and 2012 to provide material support to terrorists.

Lawsuit alleges terrorist’s mother knew of planned San Bernardino attack

Minnesota Life Insurance Co. is alleging in a federal lawsuit that the mother of San Bernardino mass shooter Syed Rizwan Farook knew of her son’s planned terrorist attack and should not be entitled to $275,000 in life insurance benefits.

The lawsuit, filed Wednesday in U.S. District Court in Riverside, alleges Rafia Farook was living in the Redlands apartment with her 28-year-old son, a San Bernardino County health inspector, and his wife, Tashfeen Malik, at the time of the Dec. 2 attack at the Inland Regional Center.

[...]In January 2012, Syed Farook took out a $25,000 life insurance policy, designating his mother as the primary beneficiary and Khan [sister] as the contingent beneficiary. In July 2013, he took out a supplemental life insurance policy for $250,000, also naming his mother and sister as the primary and contingent beneficiaries, respectively, according to the lawsuit.

San Bernardino shooting: Enrique Marquez Jr. trial pushed back 8 months

The trial of Enrique Marquez Jr., who bought the rifles used in the San Bernardino attack, is being pushed back from July 19, 2016 to March 21, 2017.

The change was requested in a filing from Marquez's attorneys last month and was granted by a judge on Friday. The lawyers had said that there's too much evidence to go through to make a July trial either practical or fair for their client.

The court agreed in its ruling that the case is unusual and complex enough to expect Marquez's team to be ready within time limits that are in the Speedy Trial Act. Marquez's lawyers said previously that the government's evidence includes more than 8,500 documents and 500 hours of audio interviews with witnesses.

There is also a status conference and hearing date on motions set for March 6, 2017. Motions for that hearing have to be filed by Jan. 30, 2017, with the deadline for pre-trial motions and motions to suppress evidence set for Dec. 5, 2016 and the deadline for motions for that hearing set for Oct. 3, 2016.

Brother of San Bernardino terror shooter pleads guilty in marriage fraud case

Russian 'wife' of man accused of conspiring with gunman in San Bernardino attack pleads guilty

The Russian wife of Enrique Marquez Jr., the man accused of conspiring with the shooters in the San Bernardino terror attack, pleaded guilty Thursday to entering into a sham marriage with Marquez and lying to the FBI.

In a Riverside courtroom, Mariya Chernykh, 26, entered the plea to federal charges of conspiracy and perjury, according to the U.S. attorney’s office in Los Angeles.

Appearing before U.S. District Judge Jesus Bernal, Chernykh admitted to putting false statements on her immigration paperwork, lying to FBI agents during her interviews, and giving Marquez regular payments for his continued involvement in the sham marriage.

Bernal could impose up to 20 years in prison and a $1-million fine at Chernykh’s sentencing, scheduled for Nov. 20.

Enrique Marquez, Jr. plead guilty today to providing the high-powered rifles used to kill 14 people in the terror attack.

Victims families will be allowed to speak at his sentencing scheduled for August 21st.

Sentencing for Marquez in Dec. 2-related firearms case reset for Nov. 6

The sentencing for Enrique Marquez Jr., who pleaded guilty to charges related to the Dec. 2, 2015, San Bernardino shooting, has been postponed by more than two months.

Marquez faces up to 25 years in prison and $500,000 in fines when he is sentenced at 2 p.m. Nov. 6 in U.S. District Court, Central District for California, in Riverside. Sentencing had previously been set for Aug. 21.

Both the prosecution and defense requested additional time to prepare for sentencing, according to court documents. Marquez requested additional time to prepare a statement; prosecutors said they might include a report from an expert witness who said he couldn’t complete the report before Sept. 15.

Judge Jesus G. Bernal approved the request.

Sentencing for Riverside man who aided San Bernardino shooter is postponed

The sentencing for Enrique Marquez Jr., the Riverside resident convicted of purchasing the weapons used in the Dec. 2, 2015, San Bernardino shooting, has been postponed.

The sentencing in U.S. District Court in Riverside had been scheduled for Tuesday, Nov. 6. The hearing is now scheduled for Feb. 26.

Marquez agreed to a plea deal that could imprison him for the statutory maximum sentence of 25 years to life in federal prison and a $500,000 fine.

February 26, 2018 sentencing delayed. No date set.

Marquez sentencing date for San Bernardino terror attack role is July 13

A federal judge has set July 13 as the sentencing date for Enrique Marquez Jr., the Riverside man who has admitted supplying AR-15-style rifles used by the two terrorists in the San Bernardino mass shooting of Dec. 2, 2015 that killed 14 people and wounded 22.

U.S. District Judge Jesus G. Bernal ordered the new date on Monday afternoon. In a previous order, the Riverside-based judge said he would not consider any more sentencing delays in the case. This will be the fourth sentencing date for Marquez, 26, who faces up to 25 years in prison.

What appeared to be a rock-solid July 13 sentencing date for Enrique Marquez Jr., who has admitted supplying the assault rifles used by the two terrorists in the Dec. 2, 2015, San Bernardino shooting that killed 14 people and wounded 22, has been postponed indefinitely after Marquez obtained a new attorney.

U.S. District Judge Jesus G. Bernal had set the July 13 date at an April hearing in Riverside after saying that he would not consider any more sentencing delays in the case.

The next sentencing date will be the fifth for Marquez, 26, a graduate of La Sierra High in Riverside who faces up to 25 years in prison. He pleaded guilty in February 2017 to conspiracy to provide material support to terrorists and making a false statement in connection with the acquisition of firearms.

Marquez remains in federal custody.

New sentencing dates have been set for two Russian sisters who admitted their roles in a fake-marriage scheme involving a friend of Syed Rizwan Farook, who with his wife killed 14 people and wounded 22 others in the Dec. 2, 2015 San Bernardino terror attack.

The sisters, Tatiana Farook and Mariya Chernykh, were to be sentenced separately in Riverside federal court during the next 2 1/2 weeks, but are now scheduled to be sentenced in the spring.

The bogus marriage of Chernykh to Enrique Marquez Jr. was a scheme to prevent Chernykh’s deportation, authorities said. Marquez was the illegal straw buyer of two AR-15-style rifles Syed Rizwan Farook and wife Tashfeen Malik used in the attack, the FBI said.

Tatiana Farook, sister-in-law of Syed Rizwan Farook, now faces an April 15, 2019 sentencing date for her guilty plea in February 2017 to one felony count of conspiracy to commit immigration fraud. She had been scheduled for sentencing Oct. 22.

The sentencing date for Chernykh was moved from Nov. 5 to May 20, 2019. She pleaded guilty to conspiracy, perjury and two counts of making false statements in January 2017.

Syed Raheel Farook, the husband of Tatiana and older brother of Rizwan, faces a March 25, 2019 sentencing for his role in the sham marriage plot. He has pleaded to one count of conspiracy to commit immigration fraud. His sentencing date was changed last month, from Sept. 24.

“The mother of Syed Rizwan Farook, the male shooter in the 2015 San Bernardino terrorist attack,” the U.S. Attorney for California’s central district reports, “has agreed to plead guilty to a federal criminal charge of intending to impede a federal criminal investigation by shredding a map her son generated in connection with the attack.”

Rafia Sultana Shareef, 66 also known as Rafia Farook, “has agreed to plead guilty to a one-count information charging her with alteration, destruction, and mutilation of records,” according to the March 3 statement.

After the attack, Shareef learned her son Syed had been identified as a suspect, and told family members that Syed and his wife Tashfeen Malik had perpetrated the attack at the Inland Regional Center. Shareef “fed into a shredder” Syed’s map, directly related to the planning of the attack that took place on December 2, 2015. Syed Farook’s mother is slated to appear in federal court on March 16. She faces a maximum sentence of 20 years but according to the U.S. Attorney, “the plea agreement contemplates a sentence of no more than 18 months.”
