| The judge in the Aurora theater shooting case released 63 jurors Tuesday, including one who broke down and pulled out clumps of her hair when court staff wouldn't immediately release her.

The woman told the judge earlier in the day that she brought her grandchild to court with her because the child has not been immunized and no daycare would take them.

CENTENNIAL, Colo. — A video discussed at a Monday morning hearing in the Aurora theater shooting trial may show James Holmes endangering Arapahoe County Sheriff’s deputies while he was being jailed in a courthouse holding cell. And that video may be thrown out by the judge.

The issue at hand during Monday morning’s hearing was whether the custodians of this video should have turned the surveillance footage over sooner.

Specifically, the video is an 11-minute segment of surveillance footage pulled from Holmes’ stay in an Arapahoe County Courthouse holding cell on Sept. 20, 2012. In the video Holmes, the admitted gunman in the 2012 theater shooting that left 12 dead and 70 more injured, did something that led deputies to take the footage to Detention Services Bureau Chief Louie Perea.

— 2,000 were told they did not have to report to fill out questionnaires because enough promising candidates had been identified.
— More than 1,000 were dismissed for various reasons.
— Hundreds will return for individual questioning.
— 120 will be chosen to return again to be questioned in groups.

– A Vietnam veteran, an attorney and an art director were among the first people questioned directly about their views on the death penalty and mental illness as the second phase of jury selection began Wednesday in the Colorado theater shooting case.

In the weeks ahead, hundreds of people who were not excused after filling out lengthy questionnaires will be asked about their beliefs and background and what they know about the case.

Among the five people Judge Carlos A. Samour Jr. excused Wednesday was a Vietnam War veteran who said he had post-traumatic stress disorder and cannot view graphic images without suffering symptoms.

Such images will likely be introduced at the trial of James Holmes in the July 20, 2012, attack at a Denver-area theater that killed 12 people and injured 70 others.

He’s likely the most hated man in Colorado after killing a dozen people in a 2012 shooting spree, but taxpayers will spend at least $7 million to try James Holmes and help survivors of the attack - and opening arguments haven't even begun.

The Arapahoe County District Attorney’s Office has disclosed more than $2 million in direct and indirect expenses involved in prosecuting the 27-year-old former neurology graduate student. But it is not clear how much has been spent by the Colorado public defender, because the office, citing attorney-client privilege, refuses to disclose a figure. That stance has critics fuming.

“This killer has taken enough from our community,” said Jon Caldara, president of the Colorado-based free market think tank, Independence Institute. “We should at least have the right to know what we are spending on him.”

The public defender’s stance, cited in the denial of a Freedom of Information Request made by FoxNews.com, faces a challenge Thursday, when two state lawmakers urge colleagues to support their bill forcing the agency to give a public accounting.

CENTENNIAL — Juror No. 86 looked like a schoolkid, sitting pensively in the jury box and gazing up to where the judge presided above her.

On her juror questionnaire for the Aurora movie theater shooting case, she had noted that her oldest daughter had planned to go to a movie on the same night as the shooting, then canceled. Moments earlier, No. 86 had told the judge it would be hard to listen to evidence in the case and not wonder what could have been if her child had been in the theater that night.

Now, the judge had come to the crux of the jury selection process, and he looked at No. 86.

"If selected for this case, can you be a fair and impartial juror?" he asked.

She paused.

"I would like to believe that I could be objective," she responded. "I do believe I can do that."

She passed.

Through three days of individual questioning of potential jurors, the judge and attorneys in the Aurora theater shooting trial have approved 16 jurors for the final stage of jury selection. That is exactly half of the jurors questioned, and at a rate far better than anyone predicted.

Prosecution carefully avoids calling Holmes by name in theater shooting jury selection

CENTENNIAL, Colo. — Would you be capable of sentencing that man to death?

It’s a question the prosecution in the Aurora theater shooting trial has posed to each prospective juror through five days of individual questioning as the court works to whittle a jury pool of 9,000 down to 24. It’s a question that always draws an objection from the defense team for James Holmes, the admitted gunman in the July 2012 shooting that left 12 dead and 70 others wounded.

Those objections from the defense are always overruled by Arapahoe County District Court Judge Carlos Samour.

To be clear, the defense has logged multiple objections to the question. On Tuesday, one of those objections was to Arapahoe County District Attorney George Brauchler calling Holmes “that man in the corner.”

Defense attorney Kathryn Spangler insisted that the “in the corner” reference implied wrongdoing. Not only that, she said, but since the court has been shackling Holmes to the floor during court proceedings, there is no other place for him to sit aside from in the corner.

Brauchler insisted his usage of “in the corner” carried no deeper meaning, and Samour agreed, saying he didn’t see the reference as vindictive. Nonetheless, Brauchler agreed to refrain from using it in the future, and instead referred to Holmes as “that man in the sweater with glasses, a mustache and a beard” on Wednesday.

Though the reference was somewhat comical in its detail, it remained in line with a successful and perhaps strategic effort from the prosecution to avoid mentioning Holmes by name in this trial. It’s an effort that would seem to be lauded by many victims in this case, as well as by Dr. Park Dietz, a noted psychiatrist whose extensive research on the perpetrators of mass atrocities has led him to believe that depriving them of notoriety could serve to prevent future atrocities.

Dietz’s public comments on the matter are often cited in the “Don’t Name Them” campaign. Its supporters are active in promoting the corresponding hashtag on social media and urging — sometimes even badgering — journalists to refrain from mentioning Holmes by name when reporting on this case.

But it wouldn't be fair to say the defense’s objection to the aforementioned question centers solely on the prosecution’s references to their client. The defense insists it is a “stakeout question,” the legal definition of which has been defined, among other places, in the 1998 case of the State of North Carolina v. Early Richmond Jr. Richmond was ultimately convicted of killing four people, sentenced to death and executed.

“Stakeout questions,” the court reasoned in the Richmond case, “seek to cause prospective jurors to pledge themselves to a future course of action and indoctrinate (them) regarding potential issues before the evidence has been presented and (they) have been instructed on the law.”

Holmes trial may start sooner than expected

CENTENNIAL – Jury selection has moved more quickly than expected in the Aurora theater shooting case and the trial could begin as early as May, a judge said.

Direct questioning of potential jurors had been set to last four months, but Judge Carlos Samour said Wednesday it could wrap up in six weeks instead, The Aurora Sentinel reported.

Samour asked one man on Thursday if a trial that starts in late April or early May would pose a hardship. He replied it would not.

James Holmes has pleaded not guilty by reason of insanity in the 2012, attack at a suburban Denver theater that killed 12 people and wounded 70 others.

His lawyers acknowledge he was the gunman but say he was in the grip of a psychotic episode.

Samour noted during proceedings on Thursday that one jury candidate had made references on a questionnaire about the length of time the case has already taken.

“Given the magnitude of this case it hasn’t taken that long,” the judge said. “We take our time in these cases given what’s at stake.”

The prospective juror was among three people released Thursday after saying they could not impose the death penalty because of religious beliefs.

CENTENNIAL, Colo. – The judge overseeing the Colorado theater shooting case says jurors can see a video of defendant James Holmes in a holding cell that was recorded two months after the attack.

Judge Carlos A. Samour's order Monday came over objections from defense attorneys who said the video should be excluded from evidence because prosecutors shared it too late. The 11-minute video shows Holmes in a cell at the courthouse on Sept. 20, 2012, but its significance hasn't been disclosed.

Holmes has pleaded not guilty by reason of insanity to charges of killing 12 people and injuring 70 in the July 20, 2012, shooting.

Jury selection is ongoing, and opening statements could happen in April or May.

Samour says attorneys will have time to study the video during a possible week-long break during jury selection.

CENTENNIAL, Colo. — It was as blunt a statement as the court had received in two-plus years. And it came from the mouth of Arapahoe County District Court Judge Carlos Samour.

Quoting a potential Aurora theater shooting jurors’ questionnaire, Samour said, “In response to the question dealing with potential penalties, you wrote — and I quote — ‘Hang his a**.’ Is that correct?”

“Yes,” the juror responded without a moment’s pause. Both the prosecution and defense agreed to his excusal just as swiftly.

The excused juror, a white man in his 60s who showed up for jury duty Thursday morning donning an Air Force Academy sweatshirt, was of course referring to James Holmes, the admitted gunman in the July 2012 shooting that left 12 dead and another 70 injured.

Holmes has pleaded not guilty by reason of insanity.

While the statement was as brash as the court has seen, it has seemed at times that other jurors have simply been too polite to echo those same sentiments. Several other jurors, including one this week who was also excused, have gone so far as to admit they had no idea this trial was still ongoing until they were called to court as a prospective juror.

“I was talking about the verdict with my brother the other day,” one excused juror said. “I guess there hasn’t been one yet.”

Defense will renew request to move Aurora theater shooting trial

CENTENNIAL, Colo. — Last April, defense lawyers in the Aurora theater shooting case requested a change of venue for the trial. District Court Judge Carlos Samour Jr. said the only way to find out if Arapahoe County could sit a fair and impartial jury was to try.

Despite what has been characterized as better-than-expected progress six weeks into jury selection, the defense informed Samour on Monday that they don’t have any plans to rescind their request for a change of trial venue. Samour indicated he will hear oral arguments on the venue change request at the conclusion of individual questioning, which will likely be in early April, almost a year after the initial request was filed.

Kristen Nelson is part of the team of public defenders representing James Holmes, the admitted gunman in the July 2012 shooting that left 12 dead and 70 injured. She said her team will begin filing motions next week detailing media coverage of the case since the defense’s last change of venue request.

ARAPAHOE COUNTY, Colo. - Jury selection in the Aurora movie theater shooting trial is continuing with attorneys asking prospective jurors about their views on the death penalty and mental illness.

As of Tuesday, Judge Carlos Samour had asked 47 potential jurors to return for more questioning. He hopes to have 120 from which to choose 12 jurors and 12 alternates.

Those selected will decide if the defendant was legally insane during the 2012 attack that left 12 dead and 70 injured. The defendant has pleaded not guilty by reason of insanity. Prosecutors are seeking the death penalty.

On Tuesday, Samour dismissed a woman who said she could never impose the death penalty and a clairvoyant, out of concern that she would apply her skills during testimony.

A nurse, a data analyst and a woman who has a friend who knew some of the victims were asked to return.

Amazingly enough the District Attorney George Brauchler refused to accept a "guilty plea from Holmes in exchange for a sentence of life in prison without parole" saying that "Death is justice" given colorado is a NGBRI state and their statute is colly waggled and defense friendly I wish Brauchler would have saved the state millions of dollars and taken the plea. But I say that without having talked to the families of the victims so maybe the families want the prosecution to gamble and go for the death penalty.

Has anyone read much about Holmes? Does he appear to be deeply mentally ill or just another bad character ? If I remember right Holmes was a student, had been seeing a psychologist (or mental health something or other ) and was reading and doing research into mental illness at the time of his rampage.

Judge moves up date for opening statements in Aurora theater shooting trial

CENTENNIAL, Colo. — The judge in the Aurora theater shooting trial set a new date for opening statements on Thursday, moving the date up from its tentatively scheduled date in June to April 21.

Arapahoe County District Court Judge Carlos Samour also said opening statements could begin on April 27, if one of the jurors who has been retained for the next phase of jury selection actually ends up on the jury. That particular juror is getting married the week of April 21.

Both the defense and the prosecution made arguments in favor of the April 27 date.

Prosecutors in Colorado cinema massacre trial seek to restrict graphic images

DENVER (Reuters) - Prosecutors in the murder case against Colorado cinema gunman James Holmes are asking that crime scene and autopsy photographs and videos of victims be restricted at the upcoming trial, court records showed on Friday.

In a filing, the prosecutors request that Arapahoe County District Court Judge Carlos Samour rules the graphic images can only be shown to the jury, lawyers and himself, and not to the courtroom gallery or be broadcast by news media.

"Although the photos ... are unfortunately necessary evidence for the trial, allowing the media and the public (the) right to view all of them is completely unnecessary," the motion said.

Defense lawyers do not object to the request, prosecutors said.

Jury selection is underway, and Samour said he wants lawyers to present their opening statements next month.

Jury selection began in January, when more than 9,000 prospective jurors were summoned in what experts called the biggest jury pool in U.S. history. After filling out lengthy questionnaires, thousands were asked to return for individual questioning that began Feb. 11 and has so far yielded more than 50 people who can come back for still more screening.

Judge Carlos A. Samour Jr. hopes to seat a jury to hear opening statements on April 21 or April 27.

Holmes has pleaded not guilty by reason of insanity. If jurors find he was sane, they will decide whether he should be put to death.

Days are long, with attorneys questioning, at most, 12 people a day, sometimes grilling one person for hours at a time.
