CENTENNIAL, Colo. (AP) — The judge in the Colorado theater shooting trial dismissed three jurors Tuesday after learning that one was exposed to news coverage of the case and discussed it with the others.

The first woman told Samour her husband called her and told her, on speakerphone, that the district attorney had sent a tweet during testimony, which had been in the news.

The other two jurors, who sometimes socialized with the first juror on breaks, were dismissed because they likely overheard her.

The issue stalled Tuesday's testimony, but Samour refused to let it derail the trial, which is in its seventh week.

Samour's cuts came after he separately questioned each juror at length about what they had heard. He tried to ensure both sides were comfortable with the outcome.

He decided against getting rid of a fourth juror who said she had heard the first dismissed woman mention the word "mistrial" but didn't know what it was about.

Samour also refused a defense request to dismiss a fifth juror, who had informed him about the situation, saying she had been honest and wasn't compromised. "Thank you for doing the right thing," he told her when she came forward, visibly distraught.

This is why they started the trial with an unusual number; 24 jurors and 12 alternates. Thank goodness. :)

Yes, I agree. I think he made too many elaborate, well thought-out preparations, prior to the actual shooting.

Centennial, Colorado - The capital murder trial of James Holmes reached a turning point when the prosecution rested its case this week, calling as its last witness a victim who survived the movie theater massacre but lost her pregnancy and her small daughter.

Her powerful testimony capped two months of work for the jury thus far.

It was also a week where the jurors themselves were in the news -- again. Another was dismissed.

Next week jurors will begin hearing the defense's case. Holmes, 27, a one-time promising doctoral student in neuroscience, has pleaded not guilty by reason of insanity to 165 counts alleging he killed 12 people and injured 70 more at a midnight showing of the new Batman movie "The Dark Knight Rises" in Aurora, Colorado, in 2012.

Defense begins case in James Holmes trial

CENTENNIAL, Colo. - Attorneys for Colorado theater shooter James Holmes began presenting their case Thursday, hoping to show he was legally insane when he killed 12 people and wounded 70 others at a packed movie premiere in July 2012.

Defense witnesses will offer a less emotional and more clinical assessment of Holmes after two months of often-gruesome testimony from prosecution witnesses, including many visibly wounded victims.

Without the scores of victims on their side, Holmes' attorneys plan to present its evidence in less than a quarter of the time taken by prosecutors. Their goal is not only to keep Holmes out of prison but also to keep him alive.

The defense's first witness was a nurse, Jason Frank, who worked at Arapahoe County Jail in November 2012, when Holmes ran headfirst into walls and fell backward on his bed, sending him to the hospital. Defense attorneys also showed a video of Holmes falling to the ground and lying there supervised by some deputies for several minutes.

After the footage was shown, prosecutors grilled Frank about his observations of Holmes over several weeks. The nurse testified that Holmes was a little nervous when coming to jail but that his demeanor was typical of most new inmates.

Asked whether Holmes otherwise displayed odd behavior, Frank said, "nothing out of the ordinary."

The defense then called a psychiatrist who interviewed Holmes less than a week after the shooting.

ARAPAHOE COUNTY, Colo. - Testimony could conclude this week in the Aurora movie theater shooting trial.

Defense attorneys indicated last week that they expect to call their final expert, psychiatrist Raquel Gur, on or around Tuesday. Public Defender Dan King suggested his direct examination of Dr. Gur would take about a day and he guessed the prosecution might need another day for cross-examination.

Dr. Gur is a professor of psychiatry neurology and radiology at the University of Pennsylvania's Perelman School of Medicine. She leads the neuropsychiatry section and the Schizophrenia Research Center and is vice chair of research development in the Department of Psychiatry.

King and his colleagues are trying to convince the jury that James Holmes is not guilty by reason of insanity. He is accused of killing 12 people and injuring 70 others in the July 20, 2012 mass shooting at a crowded Batman movie premiere.

The man who allegedly opened fire during a 2012 midnight showing of a ‘Batman’ film at an Aurora, Colo. movie theater will not testify in his death penalty trial.

James Eagan Holmes, 27, told Arapahoe County District Chief Judge Carlos A. Samour Jr. Thursday that before making the decision not to testify, he discussed it with his attorneys.

Had Holmes chosen to testify, prosecutors would have been able to cross examine him. Samour determined that Holmes' decision not to testify was made "voluntarily and intelligently."

Shortly before 5 p.m. local time, Samour addressed Holmes inside the Centennial, Colo. courtroom.

Holmes responded to the judge's questions with direct "Yes" and "No" answers, and swiveled slightly in his chair.

CENTENNIAL — At 10:47 a.m. Friday, after 256 witnesses and 47 days of courtroom proceedings, the testimony phase in the Aurora theater shooting trial came to a close.

"At this time, the defense rests," said Dan King, one of five attorneys representing the defendant.

Almost immediately, the mood in the courtroom changed. The gravity and seriousness of the past three months seemed to lift as victims' families hugged, and jurors appeared giddy over the news of being dismissed for a long weekend before lunch.

Even Judge Carlos Samour Jr. seemed ready to move on as he nearly forgot to admonish the jury about discussing the trial or watching the news during the three-day break before closing arguments Tuesday. A staff member reminded the judge as the jury stood to leave.

Closing arguments are scheduled to begin Tuesday morning, exactly three months after a jury was seated. The trial began April 27.

Each side gets two hours to summarize its case. The prosecution will go first, followed by the defense. The prosecution then gets a chance for rebuttal. Brauchler and King will deliver the closings.

The seven alternate jurors will be sequestered at the courthouse while the 12 deliberate.

Once a verdict is reached, Samour said he will give three hours of notice to allow attorneys, victims and their families to get to the courthouse.

Deliberations will bring a new kind of tension for the victims and their families, Phillips said.

She said she has faith that Brauchler and his team have been convincing.

"It's all about his closing, and then it will be all about what the jury thinks," Phillips said. "Once we have an outcome, I'll never have to see that killer's face again."

If jurors find Holmes guilty, the trial would then shift to a penalty phase, with more testimony. Prosecutors are seeking the death penalty.

ARAPAHOE COUNTY, Colo. - Attorneys and the court have spent several days debating how Tuesday's closing arguments will go in the movie theater shooting trial, but they'll also have to follow the established procedures of the court.

Court will convene at approximately 9 a.m. and start with the reading of the long list of instructions that were finalized Monday. Attorneys jostled over the content and even the grammar of those instructions for several days.

"The vast majority of reversals on appeal come from jury instructions," said 7NEWS Legal Analyst David Beller. "The attorneys are being incredibly diligent and careful in the crafting of the instructions knowing that if there is a conviction, every word is going to be analyzed."

Photos of the 12 people who died in the Colorado theater shooting were the last images jurors saw before starting deliberations Wednesday over whether the gunman, James Holmes, was legally insane when he opened fire on a crowded midnight movie premiere.

The 12 jurors who will decide the case include nine women and three men. The seven alternate jurors won't participate in the deliberations but must remain available in case one of the other jurors can't go on.

"We're praying the jury does the right thing, praying to God," said Rena Medek, whose daughter, Micayla Medek, died in the shooting. She attended the trial daily with Micayla's grandmother, Marlene Knobbe.

"Just because the trial is over, it's not over for us," said Sandy Phillips, whose daughter, Jessica Ghawi, was also killed. "It's never going to be over for the 12 families who lost their loved ones in that theater."

Verdict Watch

Jurors went home on Wednesday without reaching a verdict, and will resume deliberations on Thursday.

By late-afternoon, Arapahoe County District Court Judge Carlos Samour had summoned lawyers for both sides into court three times in response to written queries from the jurors.

The questions included whether they could be given an index to the thousands of pieces of evidence to locate items more quickly. But Samour said that would not be possible because both sides would contest the descriptions of the evidence.

"They'll have to do it the hard way," the judge said.
