Tsarnaev Lawyers Ask Appeals Court to Order Trial Moved

AP — Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev (joh-HAHR' tsahr-NEYE'-ehv) have asked a federal appeals court for the second time to order the judge to move his trial outside of Massachusetts, arguing he cannot get a fair trial here.

The defense filed its request late Tuesday. It asked the 1st U.S. Circuit Court of Appeals to order Judge George O'Toole to move the trial or to suspend jury selection until he rules on a third change of venue request.

The 1st Circuit rejected a similar request last month, before jury selection began.

In their new request, Tsarnaev's lawyers say their review of questionnaires filled out by 1,373 prospective jurors show that 68 percent already believe Tsarnaev is guilty.

Three people were killed and more than 260 were injured when two bombs exploded near the marathon finish line in April 2013.

Appeals court: Tsarnaev prosecutors must respond to change of venue motion

A federal appeals court has given the prosecutors in the trial of accused Boston Marathon bomber Dzhokhar Tsarnaev a deadline of 5 p.m. tomorrow to respond to a defense request to move the case out of state.

That order was handed down last night by the U.S. Court of Appeals for the First Circuit after Tsarnaev’s lawyers filed an emergency motion asking appellate justices to intervene in the proceedings.

The defense team’s third request for a change of venue, which was filed Jan. 22, has not yet been acted on by U.S. District Court Judge George A. O’Toole.

Last night, the defense filed a second petition asking the federal appeals court to grant a change of venue and order a stay of jury selection. Their earlier request last month was denied.

O’Toole and the two trial teams return to jury selection proceedings this morning after the second weather-related two-day suspension in two weeks.

After 12 days and 114 interviews with prospective jurors, no jurors have been seated.

BOSTON -- A federal judge on Friday rejected a third request from lawyers for the Boston Marathon bombing suspect to move his trial outside Massachusetts, saying jury selection so far has shown people are capable of being fair and impartial in the place most affected by the deadly attack.

Judge George O'Toole Jr. said in his written ruling that "substantial progress" has been made toward a goal of finding 70 potential jurors. Once that number is reached, prosecutors and Dzhokhar Tsarnaev's defense team will then be allowed to eliminate 23 people each for strategic reasons.

Snow Delays Jury Selection In Marathon Bombing Trial

BOSTON - Jury selection has been postponed in the trial of Boston Marathon bombing suspect Dzhokhar Tsarnaev.

The U.S. District Court in Boston will be closed on Monday due to a prolonged snowstorm expected to dump up to two feet of new snow on the socked-in region. Jury selection should resume Tuesday.

On Friday, Judge George O’Toole Jr. said the court has made “substantial progress” toward finding 70 potential jurors as he seeks to empanel 12 jurors and six alternatives. The jury will decide whether Tsarnaev is guilty and then determine whether he gets the death penalty. O’Toole has questioned 157 prospective jurors so far.

BOSTON — A federal appeals court said Thursday that it would hear arguments on whether to move the trial of Dzhokhar Tsarnaev, the defendant in the Boston Marathon bombings, out of the city.

The decision by the United States Court of Appeals for the First Circuit comes as jury selection in the case has dragged on for several weeks, delayed by the weather and the tedious process of selecting potential jurors from a list of more than 1,300 who filled out questionnaires. The judge overseeing the case, George A. O’Toole Jr. of Federal District Court, has rejected three requests by Mr. Tsarnaev’s lawyers to move the trial.

The appeals court, which refused a defense request in January to intervene, scheduled arguments for next Thursday, said Susan Goldberg, the circuit executive. Until then, the court said, jury selection will continue.

He is being charged under the federal death penalty law. Massachusetts abolished its state death penalty in 1984.

Tsarnaev, has pleaded not guilty to 30 federal charges in connection with the bombings. Seventeen of the charges carry the possibility of the death penalty.

BOSTON -- As of Friday, 54 potential jurors have been deemed qualified to serve in the case of Dzhokhar Tsarnaev, the man accused of setting a bomb at the finish line of the 2013 Boston Marathon, according to court documents.

The court must have a pool of at least 68 potential jurors before entering the final phase of jury selection, in which lawyers from the prosecution and the defense can strike up to 23 jurors per side. Eventually, there will be 12 jurors and six alternates chosen to serve.

U.S. District Court Judge George O'Toole and the lawyers must find jurors who are able to be impartial, who are potentially willing to impose the death penalty and who will not face serious hardship from a three- or four-month trial. So far, 193 potential jurors have been interviewed. The judge and lawyers have been conferring at the end of each day of individual jury questioning in private. The Boston Globe, joined by WBUR and Cable News Network, asked the judge in court motions to inform the public about which jurors have been excused.

Yes is does. :) This drawing shows a more casual setting for voir dire (French "to speak the truth") than what we would normally see in state trials.

The law in Massachusetts is, in both state and federal court, the judge alone asks the questions. Judges may allow the lawyers to submit subsequent questions in writing for the judge to ask. Judge O'Toole says he may allow attorneys to ask a limited number of follow-up questions as may be appropriate. The 54 prospective jurors have already written their answers to 28 pages of questions.

BOSTON (CBS/AP) — Prosecutors have urged a federal appeals court to reject a bid to move the trial of Boston Marathon bombing suspect Dzhokhar Tsarnaev out of Massachusetts.

In a filing Tuesday with the 1st U.S. Circuit Court of Appeals, prosecutors noted that the judge has already qualified 54 people to serve as jurors. They said of those, 63 percent indicated they have not formed an opinion that Tsarnaev is guilty and 37 percent indicated they could set aside their opinions and be impartial.

Tsarnaev’s lawyers say he cannot receive a fair trial in Massachusetts because too many people believe he’s guilty and have personal connections to the marathon or bombing.

As an example of the “ongoing and pervasive public reminders of the Marathon bombings and their aftermath,” the defense submitted a February 12 photo of a cement truck near the Moakley Courthouse bearing the slogans “Boston Strong”; “This is Our * * * * * * * City”; and “Thank You First Responders.”

The defense also said that a Boston Strong banner “literally overshadowed” the court in 2014.

BOSTON — With her arm around the young man's back, she gives him a gentle pat and leans in to whisper something to him. Judy Clarke could be his mother, with this simple, comforting gesture, but she is not.

She is a defense lawyer and he is accused of bombing the Boston Marathon.

Clarke has defended those accused of horrific and infamous crimes, including Unabomber Ted Kaczynski, Atlantic Olympics bomber Eric Rudolph and Arizona shooter Jared Lee Loughner, who killed six people and injured 13 others, including U.S. Rep. Gabrielle Giffords, in 2011. She saved all of them from the death penalty and hopes to do the same for Dzhokhar Tsarnaev, the man accused in the 2013 marathon bombing that killed three people and injured more than 260 others.

AP - Individual questioning of prospective jurors in the trial of Boston Marathon bombing suspect Dzhokhar Tsarnaev (joh-HAHR' tsahr-NEYE'-ehv) is scheduled to resume Tuesday, as jury selection nears completion.

Judge George O'Toole Jr. has questioned 235 potential jurors so far. He said last week he has provisionally qualified 61 people to serve as jurors. The judge has said he wants a pool of 70 before he allows prosecutors and Tsarnaev's lawyers to eliminate some people for strategic reasons. A panel of 12 jurors and six alternates will be seated to hear the case.

Jury selection is expected to be completed this week. Openings statements are expected next week.

Tsarnaev is accused in the 2013 attack that killed three people and injured more than 260. He faces the possibility of the death penalty if convicted.

BOSTON (CNN) — The death penalty trial of accused Boston Marathon bomber Dzhokhar Tsarnaev -- long delayed by painstaking jury selection, crippling snowstorms and last-ditch appeals to move the case someplace else -- is on track to finally get underway here next week.

Judge George O'Toole, along with the prosecution and defense teams, settled on a pool of 70 jury prospects on Wednesday -- the 21st day of individual juror interviews.

On Tuesday, attorneys will weed out jurors they believe are less sympathetic to their case. These "preemptory challenges" let attorneys remove jury prospects without giving a reason. Each side gets 20 challenges for the main jury and three for the alternates.

By Wednesday morning, March 4, a panel of 12 jurors and six alternates is expected to be formally seated to hear opening statements and the first witnesses to an event that cut Boston to its core. O'Toole indicated the trial could last well into June.

The jurors first will decide whether Tsarnaev is guilty of using weapons of mass destruction to kill people at a large public event. If convicted, the jury then will decide whether he should be punished by life in prison without the possibility of release or death by lethal injection.

Why Russia Matters to the Boston Bombing Suspect’s Defense

Are Dzhokhar Tsarnaev’s lawyers trying to defend his case on the facts at all, or are they just trying to save his life?

Based on the overwhelmingly lopsided advantage the government holds, with a virtual monopoly on investigative evidence, it’s safe to assume the latter.

Whether the intent is to deny Tsarnaev a) any infinitesimal chance of proving his case—or even lessening the charges against him—or b) to prevent embarrassing information from leaking out at trial, the government has brought the legal version of “full spectrum dominance” warfare to a knife fight.

But a close look at the nature of the information Tsarnaev’s defense team has repeatedly requested from prosecutors in motions to the court suggests Tsarnaev’s lawyers are trying to pry loose something about the government’s relationship with the Tsarnaevs prior to the bombing on April 15, 2013.

The key to this relationship may lie in a store of information that the Russians delivered to U.S. investigators in the days after the bombing. Equally, it may be found in warnings Moscow delivered to U.S. investigators before the attack. Either way, the U.S. government has fought hard to keep the lid on what it knows.

Once again, Dzhokhar Tsarnaev has failed to get his case heard somewhere outside the immediate vicinity of the 2013 Boston bombing. On Friday, a three-judge panel from the U.S. Court of Appeals rejected Tsarnaev's request for a change of venue, despite his lawyers' claim that their client cannot get a fair trial in Boston, where nearly every potential juror has some connection to the 20-year-old's alleged crimes. The decision was split two-to-one, with judges Sandra L. Lynch and Jeffrey R. Howard ruling that Tsarnaev's trial should remain in Boston, and judge Juan R. Torruella dissenting.

BOSTON —Witnesses of the Boston Marathon bombing two years ago will recount the explosions, screams and chaos when testimony begins Wednesday in the trial of bombing suspect Dzhokhar Tsarnaev.

A panel of 12 jurors and six alternates was seated Tuesday. The panel consists of eight men and 10 women.

Tsarnaev, 21, faces 30 charges in connection with twin bombings at the finish line of the marathon on April 15, 2013. Three people were killed and more than 260 were injured. He is also charged in the killing of a Massachusetts Institute of Technology police officer days after the bombings.
