Lawyers for Boston Marathon bomber to argue for new trial

Lawyers for Boston Marathon bomber Dzhokhar Tsarnaev are due in court on Tuesday to seek a new trial for their client, who was sentenced to death in June for the 2013 bomb attack that killed three people and injured more than 260.

U.S. District Judge George O'Toole agreed last month to hear defense attorneys' arguments about a federal sentencing law that applied additional prison time for crimes committed while in possession of a firearm. The Supreme Court found it overly broad two days after Tsarnaev was sentenced to death by lethal injection.

Defense lawyers are also asking that rules put in place ahead of the trial providing them with privacy to communicate with their client be left intact as they prepare for appeal.

The defense in August asked that Tsarnaev be re-tried outside Boston, saying the intense publicity surrounding the attack and the trial unfairly influenced the 12 jurors who found their client guilty and sentenced him to death.

Tsarnaev, 22, is being held at the "Supermax" high security prison in Florence, Colorado, while his attorneys appeal his death sentence. He is not expected to be present in court, according to a spokeswoman for federal prosecutors.

I think it should be noted that Dzhokhar Tsarnaev came to America as a refugee when he was a 9 year old boy.

Let's let in another 200,000 what could go wrong?

I have NO patience with the appellate process in a DP case.
Just more money for the lawyers.

I think the defense asked for change of venue a million times. It would not have mattered where the trial was held, same outcome imo.

Every time I see Tsarnaev's name, I picture 8-y/o Martin Richard in my mind's-eye. :(

I remember this guy testifying at trial, was hesitant, but helped his case. A friend of Tsarnaev since 8th grade.

BOSTON – A man who loaned a gun used by the Boston Marathon bombers to kill a police officer is set to be sentenced on drug and gun charges.

Stephen Silva will be sentenced Tuesday in U.S. District Court.

Silva testified during the trial of Dzhokhar Tsarnaev he let Tsarnaev borrow a Ruger 9mm handgun two months before the bombings. He said Tsarnaev told him he wanted it to rob University of Rhode Island students. He also said Tsarnaev "kept coming up with excuses" for why he didn't return the gun.

Prosecutors have said the gun was used by Tsarnaev and his brother to kill MIT police Officer Sean Collier days after the bombings.

A man who loaned a gun used by the Boston Marathon bombers to kill a police officer was sentenced Tuesday to the 17 months he has already served and apologized, saying his actions were "dumb."

"I was young, dumb, and thought I could outsmart everyone," 22-year-old Stephen Silva told a judge in U.S. District Court. He pleaded guilty to gun and heroin distribution charges last year.

Prosecutors were “courting Islamophobia” during the trial of Boston Marathon bomber Dzhokhar Tsarnaev, a proceeding tainted by two lying jurors and the wrongful concealment from the jury of evidence that Tsarnaev’s older brother and co-assailant previously committed a triple murder, Tsarnaev’s legal team argued Thursday.

Those assertions were among the key arguments in a legal brief that Tsarnaev’s lawyers submitted to the US First Circuit Court of Appeals, which will ultimately decide whether to uphold or vacate Tsarnaev’s conviction and death sentence for his role in the April 2013 bombings.

The blasts, set off by Tsarnaev and his now-dead brother, Tamerlan, killed 8-year-old Martin Richard of Dorchester; Lingzi Lu, a 23-year-old Boston University graduate student from China; and Krystle Campbell, a 29-year-old restaurant manager from Medford.

  • The panel of the 1st US Circuit Court of Appeal said the judge “fell short” in screening jurors for potential bias and ordered a retrial over the sentence for Tsarnaev’s crimes,Reuters reported.
  • In the retrial, a new set of jurors can again decide whether Tsarnaev – who alongside his brother killed three people and injured more than 250 – should be sentenced to death.
