KPD fingerprint specialist dies of cancer

A Knoxville Police Department evidence technician who got the first break in the 2007 brutal torture-slaying of a Knoxville couple died Wednesday at his North Knox County home.
Daniel Wayne Crenshaw, 56, had been stricken with cancer. He is survived by his wife, son and stepdaughter.

Mr. Crenshaw's fingerprint expertise, Cox said, is what provided investigators their first clue in the January 2007 slayings of Channon Christian, 21, and Christopher Newsom, 23. The couple were abducted while on a date.

"He is the one who started the ball rolling in the Christian/Newsom murders," Cox said. "He's the one who lifted the print in the 4-Runner that put us in that house."

The victims' family members had located the abandoned 4-Runner on an east Knoxville road while searching for their missing loved ones. Mr. Crenshaw was able to lift and identify a fingerprint from one of the suspects on an envelope in the vehicle that led investigators to the nearby house where the couple had been tortured and raped for hours.

Judge sets new hearing on motion to recuse in Christian-Newsom case

KNOXVILLE (WATE) - The judge in the Christian-Newsom murders case now says he will hold a hearing in October on whether to recuse himself.
Senior Judge Jon Kerry Blackwood refused to step down from the case in a hearing on June 14.
However, in a two-page corrected order filed Wednesday, Judge Blackwood set a hearing on October 8 to consider the state's recusal motion and amended motion.
The state has five days from when the new order was filed to respond. The defendants have 30 days to file their response.
Lincoln Memorial University law professor Richard Gaines says in Judge Blackwood's new order, he seems to be rethinking some of his previous decisions.
"The judge is saying okay state if you really want me to be recused, file something in support of this motion," Gaines said.
Judge Blackwood's new order also says he will re-review his ruling for new trials for two of the defendants in the case, Letalvis Cobbins and LeMaricus Davidson.
"The new trials that were ordered are now being re-reviewed and the judge who said he's not going to recuse himself is thinking maybe he might now. We're talking entirely changed from what we had last week and a month ago," Gaines said.

State files new motion for judge's recusal in Christian-Newsom case

KNOXVILLE (WATE) - The state on Tuesday filed a new motion seeking for Judge Jon Kerry Blackwood to recuse himself from retrials in the Christian-Newsom murders case.

The state made its first recusal motion for Judge Blackwood on June 4 of this year.
Judge Blackwood on June 5 granted new trials to Davidson, Thomas and Cobbins. However, he said in a hearing on June 14 he would review his decision on Davidson and Cobbins.
The state says in its new recusal motion it has "fresh concerns about the court's impartiality."
The motion says "a judge is not to be swayed by public clamor or criticism." But the DA's office argues that Judge Blackwood admitted when reviewing the Cobbins trial he had become an advocate instead of a judge.
The DA's office also says Judge Blackwood's "remarkable anger" in that June 14 hearing on its first recusal motion is further proof that he's become too emotionally involved in the case.
In that hearing, Judge Blackwood wound up in a yelling match with District Attorney General Randy Nichols. Blackwood also accused DA Special Counsel John Gill of spreading rumors about him and mentioned a rumor that "Blackwood is dirty."
The state maintains that "No one in the Knox County District Attorney General's Office is aware of any such rumor and certainly was not the source of such a rumor if it exists."

Knox DA asking judge to again step down in Christian-Newsom case, citing new law

The Knox County District Attorney General's Office is again asking Judge Jon Kerry Blackwood to recuse himself from the Christian-Newsom cases in a new motion.

And while the judge already has put off his decision on that until this fall, after he plans to decide whether to again grant new trials for two of the four defendants, the timing of this latest motion could force his hand in the matter.

Judge Blackwood previously granted new trials for the three defendants, citing former judge Richard Baumgartner's admitted drug abuse, and later, after the Supreme Court reversed his decision, citing the 13th juror rule. Judge Blackwood, however, later set aside his decisions in the Davidson and Cobbins cases, too.

In the midst of those decisions, the state filed a motion asking Judge Blackwood to recuse himself. The matter came to a head at a contentious hearing on June 14.

That hearing forms much of the basis for the state's new motion, which was filed Tuesday afternoon.

And, because it was filed after new state rules went into effect July 1, the state is arguing that the judge must make a decision on the recusal before he can rule on any other matters in the Christian-Newsom cases.

But, because he also set an August 17 hearing for his decision on whether to grant new trials for Davidson and Cobbins, he may have to schedule a hearing on the latest motion to recuse to come before that in order to comply with the new rules.

And, while the new motion to recuse also includes the George Thomas case, Judge Blackwood has previously said his decision to grant Thomas a new trial still stands.

Also, none of the recent motions or appeals have involved Vanessa Coleman. Her new trial is still set for November

So says torture-slaying defendant George Thomas in the latest legal wrangling over Senior Judge Jon Kerry Blackwood's decision to grant new trials to the defendants in the January 2007 killings of Channon Christian, 21, and Christopher Newsom, 23.

Blackwood granted new trials to the four defendants, including Thomas, at a hearing last December. The state has been fighting the decision in three of those four cases ever since.

So says disgraced former Knox County Criminal Court Judge Richard Baumgartner in the first salvo of what is shaping up to be a battle royale over federal prosecutors' push to take away his pension via a conviction for allegedly covering up the crimes of his pill-supplying mistress.

Defense attorneys Donald A. Bosch and Ann Short this week filed their first round of motions seeking to dismiss federal charges filed against Baumgartner in the continued fallout over a Tennessee Bureau of Investigation probe into the former judge's misdeeds while on the bench.

Federal prosecutors blast Baumgartner's motion for dismissal

So says Assistant U.S. Attorney Zachary Bolitho about a motion by disgraced former Knox County Criminal Court Judge Richard Baumgartner to have federal charges against him thrown out.

"Defendant's novel argument for dismissal of the indictment is based entirely on an erroneous and incomplete understanding of the statute and the cases interpreting it," Bolitho wrote. "Accordingly, defendant's motion to dismiss for failure to allege an offense should be denied."

Christian-Newsom murder defendant plans Supreme Court appeal

KNOXVILLE (WATE) - Attorneys for one of the Christian-Newsom murder defendants want to make sure their client gets a retrial and are turning to the U.S. Supreme Court for help.

LeMaricus Davidson's defense team filed a motion Tuesday asking Special Judge Jon Kerry Blackwood to issue a stay in the case while they prepare a case to present to the Supreme Court.

Attorneys David Eldridge and Douglas Trant want the high court to overturn a Tennessee Supreme Court ruling vacating the decision to grant retrials.

The deadline for filing an appeal with the U.S. Supreme Court is August 22.

Judge Blackwood said last month he would review testimony from the trials of Davidson and fellow defendant Letalvis Cobbins while considering new trials again.

Judge Blackwood postpones decision on carjacking retrials

Judge Jon Kerry Blackwood has put off his decision on whether to grant new trials - again - for two of the defendants charged in the murders of Channon Christian and Chris Newsom.

The judge, in an order filed June 20, had originally set August 17 as the date for his decision on the retrials as well as an October 8 date for deciding on his recusal.

Last month, the state filed a new motion seeking the judge's recusal, citing a new law that went into effect July 1. That law requires a judge to first decide on any recusal before ruling on other issues in a case.

It appears Judge Blackwood has agreed with that assessment and has put off his August 17 decision.

The judge notified the affected parties in a letter, according to multiple sources who confirmed the information with 10News.

There's no word on when the judge may again take up the issue of the retrials.

Two other defendants, George Thomas and Vanessa Coleman, are not affected by these motions.

Judge still waiting to grant retrials in Christian-Newsom case

KNOXVILLE (WATE) - Judge Jon Kerry Blackwood will wait to decide whether to grant retrials in the Christian-Newsom case until after he decides on whether to recuse himself.

District Attorney Randy Nichols says he received a letter from the judge making the notification.

The state Supreme Court changed its policy recently saying judges should put a hold on any proceedings once a recusal motion is filed. Nichols says he feels the judge is following the letter of the law.

He said Blackwood's disgust with the misdeeds of disgraced former Judge Richard Baumgartner, who presided over the trials of the torture slaying defendants, has caused him to dig in his heels in granting new trials.

KNOXVILLE (WATE) - Senior Judge Jon Kerry Blackwood on Monday denied a second motion by the state to recuse himself in the Christian-Newsom murders case.

The state filed a new recusal motion for Judge Blackwood on July 24.

In court Monday, Assistant District Attorney Leland Price asked if reasonable people can have doubts about Judge Blackwood's impartiality. "They certainly can," Price said.

The ADA also discussed Blackwood's use of email to shield the media and said the "secrecy and deception" puts his impartiality into question.

No matter Judge Blackwood's ruling, "Your honor can't be trusted, even if in our favor," Price said, adding that the judge's actions undermine public confidence in these proceedings and the integrity of the court.

Attorney Tom Dillard, who represents George Thomas, said the retrials were "properly granted." He said if the state wasn't happy with the decision, maybe it's not used to losing.

Next, Letalvis Cobbins' attorney, Kim Parton, told Judge Blackwood her client wants her off the case.

Judge Blackwood denied the state's motion to recuse, but has not issued a ruling on Cobbins' request.

Parton is not to have any contact with Cobbins until Judge Blackwood makes his ruling.

The Newsom and Christian families filled the two front rows of the courtroom Monday, and they were upset by Judge Blackwood's decision.

"I cannot, will not, let that man set on my daughter's trials, not without a war. I can't do it. He ain't made a rational decision since I saw him," said Gary Christian, Channon's father.

The Newsoms said Monday was their 283rd time at court.

Special prosecutor John Gill said the District Attorney's office is consulting with the Attorney General about whether to appeal today's decision. They intend to make that decision by next week.

Defendant in Christian-Newsom case seeks U.S. Supreme Court review

In yet another wrinkle in the ongoing saga over one of Knoxville's most horrific crimes, the nation's highest court is being asked to step in.

Defense attorneys Tom Dillard and Stephen Ross Johnson are asking the U.S. Supreme Court to hear an appeal on behalf of their client, George Thomas, to decide whether a doped-up judge can deliver a constitutionally sound trial.

Thomas is one of four defendants convicted in the January 2007 torture-slayings of Channon Christian, 21, and Christopher Newsom, 23. Those convictions were upended last year after a Tennessee Bureau of Investigation probe revealed the judge who presided over their trials — Knox County Criminal Court Judge Richard Baumgartner — was himself a criminal, doctor shopping for pills, using a felon on probation in his court to get pills and using a graduate of the Drug Court program he helped found for both sex and pills. A News Sentinel investigation also showed Baumgartner was a longtime alcoholic with a history of failed rehabilitation efforts who also demanded pills from employees.

Baumgartner, spared jail on a state case and allowed to keep his state pension, now faces federal charges.

Prosecutors allege Baumgartner sold pills

Federal prosecutors said Monday they intend to prove disgraced former Knox County Criminal Court Judge Richard Baumgartner was not only a pill addict but a pill pusher.

Pressed at a hearing in U.S. District Court on what federal crime Baumgartner is accused of lying to cover up, Assistant U.S. Attorneys Zachary Bolitho and David Lewen alleged Baumgartner not only lied to various people to cover up his mistress' misdeeds but to protect a drug distribution network of which he was a part.

Defense attorney Donald A. Bosch called the claim outrageous.

"This (is a) dramatic and significant development in this case," Bosch told U.S. Magistrate Judge Clifford Shirley. "Mr. Baumgartner was not involved in any conspiracy."

Bolitho questioned Bosch's claim of surprise at the news.

"That should be no surprise," Bolitho said. "You can see from the evidence the defendant was distributing drugs."

KNOXVILLE (WATE) - Senior Judge Jon Kerry Blackwood denied that he has lost his objectivity when he wrote his latest order refusing to recuse himself from retrials in the Christian-Newsom murders.

In Judge Blackwood's most recent refusal to recuse order, filed on September 7, he wrote that he was "shocked, sickened and disgusted" by the TBI case file on Baumgartner.

Judge Blackwood originally granted new trials to the four defendants in December 2011. He and the state have since battled over recusal motions.

Blackwood wrote that after the Tennessee Supreme Court ordered him to reconsider his order of retrials for Davidson and Cobbins, he's been unable to conduct that review due to the recusal issue. He said that left those cases in limbo.

He summarized by saying that rulings unfavorable to prosecutors are not grounds for recusal.

The state has 15 days to file an appeal.
