Next, Letalvis Cobbins' attorney, Kim Parton, told Judge Blackwood her client wants her off the case.

Judge Blackwood denied the state's motion to recuse, but has not issued a ruling on Cobbins' request.

Parton is not to have any contact with Cobbins until Judge Blackwood makes his ruling.

Judge set to hear torture-slaying suspect Letalvis Cobbins' complaints about lawyer
Cobbins says his lawyer not 'enthusiastic'

A judge is set to decide next week torture-slayings suspect Letalvis Cobbins' bid to fire his taxpayer-funded attorney because he claims the attorney is not representing him with "enthusiastic and diligent devotion."

In a handwritten motion, Cobbins criticizes court-appointed attorney Kim Parton for failing to keep him informed about his case and for not filing various motions he has asked her to file.

"I, Letalvis Cobbins, the defendant seek to dismiss my court-appointed counsel due to the fact she is not working in my best interest," Cobbins wrote. "The attorney that has been appointed to me is not and has not been representing me with enthusiastic and diligent devotion."

In a bid to fight the retrial order, the state Attorney General's Office earlier this year persuaded the Tennessee Court of Criminal Appeals to remove the judge who made the retrial decision, Senior Judge Jon Kerry Blackwood. Blackwood has been replaced by Senior Judge Walter Kurtz.

Kurtz has set a Nov. 20 hearing on Cobbins' motion for the appointment of a new attorney.

Kurtz has several options: He can deny the motion. He can appoint a new attorney, or he can require Cobbins to either accept Parton's services or to represent himself.

Because Cobbins initially faced the death penalty, he was appointed two attorneys for his 2009 trial — Parton and Scott Green. He proved a difficult client, taking the witness stand over Green's objections.

A Davidson County jury, tapped because of pretrial publicity in Knox County, rejected death and sentenced Cobbins to life without parole. Green then stepped away from the case.

Cobbins has been complaining about Parton ever since, so much so she also has asked to be removed.

Letalvis Cobbins will not get new lawyer; prison treatment complaints continue

KNOXVILLE — Torture slaying suspect Letalvis Cobbins is not getting a new lawyer.

Cobbins had filed a motion asking that his taxpayer-funded attorney, Kim Parton, be replaced.

However, at a hearing today in Knox County Criminal Court, Cobbins testified he had no "complaints or problems" with Parton other than a desire to be "kept up to speed."

Parton told Senior Judge Walter Kurtz she has filed "a multitude" of motions and appeals for Cobbins despite his motion to replace her. She said she was willing to stay on the case.

"It strikes me this issue really is resolved," Kurtz said.

Cobbins continues to complain about his treatment at the hands of prison guards at the Morgan County Correctional Facility.

George Thomas granted new trial; motions denied for Davidson, Cobbins

KNOXVILLE (WATE) - Senior Judge Walter Kurtz ruled Tuesday to grant a new trial to George Thomas, one of the four defendants in the Christian-Newsom murder case.

Letalvis Cobbins and LeMaricus Davidson, both of whom also requested new trials, were denied.

Judge Kurtz ruled that he was able to sit as thirteenth juror in both Cobbins and Davidson's initial trials.

In the third case, however, the judge ruled that, "the Thomas case does involve an overriding issue, or primary issue, of credibility" because of the lack of evidence against him, including DNA evidence.

The new trial was granted because in his initial trial, former judge Richard Baumgartner was under the influence of prescription pain pills and eventually pled guilty to official misconduct.

In the judge's order, he wrote that he only gave Thomas a new trial because he couldn't sit as thirteenth juror, because he couldn't see and hear the witnesses who linked Thomas to the murders in the initial trial.

With the judge's ruling for a new trial for George Thomas, this will mark the seventh year and more than 300 times the victims' families have been in the courtroom.
