Defense: Bar 'gruesome' photographs in Christian/Newsom case

If torture-slaying suspect Vanessa Coleman has her way, jurors will never see slain University of Tennessee senior Channon Christian's smiling face or battered body.

Coleman's attorney, Ted Lavit, this week filed motions in Knox County Criminal Court seeking to bar prosecutors in her upcoming Nov. 11 retrial from using either "life photos" or "death photos" of Christian, arguing that the former would engender sympathy and the latter horror.

With Coleman's retrial looming, Lavit is hoping to score a few pretrial victories. Among his requests is that prosecutors not be allowed to show jurors photographs of Christian. Photographs of Christian before her death would "excite the passions of a jury and cause them to decide the issues based on emotion rather than reason," Lavit wrote.

Likewise, he argued, photographs of her body — found stuffed inside a trash can at Davidson's Chipman Street house — "would be potentially gruesome and horrifying" and could shock jurors into a conviction. Should he lose that argument, Lavit is asking that prosecutors use only black-and-white images to lessen "the shock value."

Lavit is also arguing that there should be no mention of Newsom at all since Coleman was acquitted in the crimes against him. Double jeopardy provisions of the law bar prosecutors from retrying any of the defendants for charges of which they were already acquitted.

Lavit has not yet challenged the state's use of its most damning evidence against Coleman — a journal in which she penned the words, "I've had one hell of an adventure since I been in the big TN!"

Coleman's defense wants no pictures of victims or evidence about Newsom admitted at retrial

The only woman previously convicted in connection with the murders of Channon Christian and Chris Newsom was in a Knox County courtroom Monday afternoon.

The couple was carjacked, raped, tortured and murdered in January 2007.

Vanessa Coleman was found guilty of facilitation in the kidnapping, rape and murder of Christian. She was sentenced to 53 years in prison. She was not found guilty on any charges related to Newsom

On Monday, Coleman's defense team asked that several pieces of evidence be withheld from her new trial. Judge Jon Kerry Blackwood has yet to rule on the motions.

The defense wants to keep any evidence about the guns found with the defendants when law enforcement apprehended them in Kentucky out of the retrial.

Lawyers argue the majority of Coleman's charges on based on Channon Christian's death and there is no evidence a gun was involved.

The district attorney's office is charging Coleman with facilitating the murder of Christian during the kidnapping of Newsom and so argue that they must prove the kidnapping, where the gun was instrumental.

Judge to decide if one victim excised

It is now up to Senior Judge Jon Kerry Blackwood to decide whether to treat victim Christopher Newsom as if he never existed in an upcoming retrial of one of four defendants in a January 2007 torture-slaying.

Defendant Vanessa Coleman contends through defense attorney Ted Lavit that because she was acquitted of charges directly related to Newsom's kidnapping, rape, torture and slaying, prosecutors should be barred from introducing any evidence related to Newsom at her Nov. 9 retrial.

"Vanessa Coleman was not found guilty of anything dealing with the male victim in this case," Lavit argued.

Judge Blackwood has been recused from retrials of Davidson, Cobbins, and Thomas but is still presiding over Coleman's trial.

Judge: Torture-slaying suspect to receive jail makeover

Let it be so ordered: Torture-slaying suspect Vanessa Coleman shall receive a new 'do.

In what may be a legal first in Knox County, a judge is ordering Sheriff Jimmy "J.J." Jones to allow a private local hairdresser to give Coleman a new look today in the run-up to next week's jury selection for her Nov. 13 retrial.

"Since I've been sheriff, it's the first order of its kind I've seen," Jones said Friday.

Defense attorney Russell Greene sought the order, sans any say by prosecutors, from Senior Judge Jon Kerry Blackwood. Jones said Greene first sought the sheriff's approval for stylist Ashley Adcock to use the Knox County Jail where Coleman is housed as a makeshift salon.

"I said absolutely not," Jones said. "I need a court order."

Greene then went to Blackwood, who obliged.

"It is hereby ordered that Ashley Adcock shall be allowed to enter Knox County Jail for the purpose of styling and coloring defendant's hair on Saturday, Nov. 3, beginning at 3:30 p.m. until same is completed," the order reads.

Greene said Coleman's parents will foot the bill.

Jury selection in the retrial of one of four suspects in one of Knoxville's most horrific crimes will be held Friday in West Tennessee.

Jurors for the new trial awarded defendant Vanessa Coleman in the January 2007 torture-slayings of Channon Christian, 21, and Christopher Newsom, 23, will be selected from Jackson, Tenn.

Senior Judge Jon Kerry Blackwood had asked that the location not be revealed before jury selection but allowed the News Sentinel to reveal it after Coleman's defense attorney, Ted Lavit, disclosed it Wednesday despite the judge's order.

Just wondering if a decision was ever made by the Tennessee Supreme Court as to whether any of the other three convicted murderers will be granted retrials. Seemed as though Blackwood ordered retrials for all State convicted perps but was overruled by the higher court & then Blackwood again tried to order retrials & demanded that he preside over them. Judge Blackwood is one corrupted, seriously narcissistic attention whore. I can’t believe the victims families have to go through the process of retrials, it’s just a shame

Judge Blackwood is a "hot mess" isn't he?
Some of his rantings are hilarious... but having followed this case and the trials the first time around.. it is too much of a tragedy to be treated as a circus like this. The facts of the case are truly horrific and the pain of the parents is so obvious and real. They already had to sit through FOUR trials. Yet now here we go again. Lets hope sanity prevails and the three male defendants do not end up being granted retrials. I do fear they will though.

I think Coleman got off lightly in her first trial. I think she was more of an active participant than the State managed to prove. As it was she got off charges related to Christopher Newsom, and more evidence is exclude this time :45
Her sentence of 53 years was adequate... I'd hate to see that reduced?

Jury selection starts this Friday.
Trial I have seen scheduled for Monday... but that may have been changed to Tuesday


If a live stream of the trial is available I will post a link. Regardless I will update important developments.

JACKSON (WATE) - Jury selection began Friday in the case against Vanessa Coleman, one of the four defendants in the Christian-Newsom murders.

On Friday, 500 potential jurors were screened in two different Jackson courtrooms.

Judge Jon Kerry Blackwood, who was removed from the other three Christian-Newsom trials, is still presiding in the case against Coleman.

The potential jurors were then asked to form a line for people who claimed it would be a hardship to participate in the trial. About 100 people in one courtroom alone lined up.

During proceedings, Coleman was dressed in pink with a new hairstyle and hair color. She gave a shy smile to potential jurors as the judge introduced her.

Judge Blackwood said the trial would take about a week and that jurors will be sequestered in Knox County during that time.

JACKSON, Tenn. — A diverse jury of seven blacks and five whites will hear evidence against torture-slaying defendant Vanessa Coleman.

The panel was picked this afternoon after some 500 people were summoned in Madison County as potential jurors.

The jury will consist of four black women, three black men, three white males and two white women.

There will be six alternates — three white women, a black woman and a white and a black man.

They will travel by bus to Knoxville on Monday and will be sequestered, staying at an area hotel. Opening statements are expected Tuesday in Knox County Criminal Court.

Special Judge Jon Kerry Blackwood agreed to pick the jury from West Tennessee because of heavy publicity the past several years about the case.

Torture slaying suspect Vanessa Coleman’s attorney accuses state of ousting black jurors

JACKSON, Tenn. — Half of the panel of 12 jurors and six alternates tapped Friday to decide the retrial of torture slaying suspect Vanessa Coleman are black.

But that did not stop Coleman's defense attorney, Ted Lavit, from accusing state prosecutors of systematically bouncing blacks from the jury pool. Coleman is black.

"In light of the numbers — seven out of eight — it appears to me to be a systematic exclusion," Lavit argued.

Lavit made what is known as a "Batson challenge," named after a defendant in a 1986 U.S. Supreme Court ruling that bars either side from using peremptory challenges — the booting of jurors without stating a cause — to exclude potential jurors because of their race alone.

Knox County Assistant District Attorney General Leland Price conceded he and fellow prosecutor TaKisha Fitzgerald, who is black, used all but one of their eight peremptory challenges to oust blacks but argued it was those potential jurors' "history of arrests," not race, that was at the root of their decision-making.

Tuesday morning, a West Tennessee jury will hear opening arguments in the retrial of Vanessa Coleman.

The trial should begin at 9 a.m. in Downtown Knoxville inside the City County Building.

The new case was caused by the former judge admitting a pill addiction.

Two years ago, Coleman was the fifth person to face trial in connection with Channon Christian and Chris Newsom's brutal murders.

Then, Coleman's attorneys argued Coleman did not take action because she was fearful of her own life.

"She attempted to put her clothes in a garbage sack and Cobbins approached her with a gun and put it to her head," Defense Attorney Ted Lavit said in Spring 2010.

Prosecutors read Coleman's grand jury testimony during the trial.

According to the testimony, Coleman saw Lemaricus Davidson, who faces the death penalty, with Channon Christian in a back bedroom.

Coleman said she saw Davidson snap Christian's neck and choke her.

A Nashville jury found Coleman guilty of facilitation of murder in Channon's death, kidnapping, multiple rapes and theft.

Coleman faced 53 years in prison. She was eligible for parole in 2026.

10News talked with Channon Christian's dad, Gary, Monday.

Gary Christian said Coleman has already faced trial and does not need a new trial.

The only reason he will attend the retrial is due to a promise he made to Channon and he also wants to sit beside his wife, Deena.
