Judge tosses one charge against Richard Baumgartner, says others iffy, ‘proof slim’

KNOXVILLE — A judge today tossed out one charge and declared the remaining six counts of a federal indictment iffy in the case against disgraced former Knox County Criminal Court Judge Richard Baumgartner.

“Frankly, the proof is slim on some of these counts,” U.S. District Judge Ronnie Greer said today.

Greer ruled there was not enough evidence to allow a jury to even consider a charge Baumgartner lied in November 2009 to Anderson County Criminal Court Judge Donald Elledge about his pill-supplying mistress, Deena Castleman, to protect a drug conspiracy of which she was a part.

Closing arguments set for Tuesday in Baumgartner federal trial

Both sides have rested in the federal trial of former Knox County Judge Richard Baumgartner; closing arguments are set to begin on Tuesday morning.

Prosecutors rested their case Monday morning after calling their final two witnesses. Knox County General Sessions Judge Andrew Jackson and Knox County Assistant District Attorney Jeff Blevins testified that Baumgartner approached them separately in 2010 about Castleman. They were involved in cases against her.

Both men described the encounters as brief, and said that Baumgartner told them to "do what you can do." But, both men also said that Baumgartner did not ask them for special favors for Castleman. That is similar to testimony two other Knox County judges gave in court last Friday.

After the prosecution rested, the defense called only one witness. Attorney John Boucher was appointed by Baumgartner to represent his former mistress, Deena Castleman. Boucher represented Castleman a number of times between 2009-2011. He testified that he met Castleman because Baumgartner appointed him to represent her on a simple-possession charge.

Boucher told the court he did not know about drug deals between Baumgartner and Castleman, nor did he know that Baumgartner was popping pills. He said he withdrew as Castleman's council when he found out about the allegations against Baumgartner earlier this year.

As expected, Baumgartner did not testify on his own behalf.

Jury begins deliberating fate of ex-judge Richard Baumgartner

KNOXVILLE — The fate of a disgraced former Knox County Criminal Court is now in a federal jury's hands.

Jurors in U.S. District Court will officially begin deliberations in the case against ex-judge Richard Baumgartner after lunch.

Baumgartner is accused of six counts of misprision of a felony for lying to various officials to cover-up mistress Deena Castleman's role in a federal drug conspiracy.

Assistant U.S. Attorney David Lewen told jurors in closing arguments this morning Baumgartner's primary goal was to protect himself.

KNOXVILLE, Tenn. (AP) - A federal jury is set to deliberate in the trial of a disgraced Knox County Criminal Court judge.

Richard Baumgartner is accused of lying to cover up a drug conspiracy.

The Knoxville News Sentinel reports during closing arguments Tuesday. Prosecutors say Baumgartner lied to protect his dealer and mistress. If she were in jail, she could not get drugs for him or have sex with him.

The jury has gone home for the night. They will resume deliberations Wednesday morning.

Jurors are deliberating the fate of former Knox County judge Richard Baumgartner.

His defense attorney, Don Bosch, completed his closing arguments earlier Tuesday, calling the case a "moral wrong" vs. a federal crime. He says there's "no remote chance" that Baumgartner concealed a federal drug conspiracy involving his mistress, Deena Castleman.

The jury began deliberations at 2:00 pm. Court will be in recess until they make a decision.

Baumgartner jury done for the day; still no verdict

KNOXVILLE — Federal jurors deliberated throughout the day today without reaching a verdict in the government's case against former Knox County Criminal Court Judge Richard Baumgartner.

About 4:30 p.m., at their request, Judge Ronnie Greer sent them home.

The 10 women and two men from the Eastern District of Tennessee resume 9 a.m. Thursday.

Jurors went home for the evening on Thursday without yet reaching a verdict in the federal trial of disgraced former Knox County Judge Richard Baumgartner. Attorneys for both sides told the court they believe the jury is deadlocked.

After more than 15 hours of deliberation over three days, the jury will require further deliberation until they reach a unanimous decision.

Thursday afternoon the jury foreman sent Judge Ronnie Greer a note with this question: "What should I write on the verdict form if we cannot come to an agreement on some of the arguments?"

Baumgartner was found guilty on 5 counts of misprision:

Count 1 (August 2009)
Lied to Anderson County judge by saying former mistress Deena Castleman was a good drug court candidate. She testified she was not doing well at that time.

Count 4 (February 2010)
Told Knox County judge that a drug charge against Castleman was "bogus" & asked him to "do what you can" for her. Castleman testified the charge was not bogus.

Count 5 (May 2010)
Told YWCA Director that Castleman passed a drug test that was a condition of her living there. Testimony proved Castleman had not passed the drug test.

Count 6 (August 2010)
Told a Knox County child support judge that criminal court was working with Castleman to get her clean, so the judge lifted her bond order. Testimony proved criminal court was not working with Castleman at that time.

Count 7 (October 2010)
Told Knox County D.A. that Castleman was "doing well" & asked him to "do what you can" for her. Castleman said she was on pills then.

The jury found Baumgartner not guilty on Count 2, which accused him of lying to nurses at St. Mary's about his relationship with Castleman to set up a pill buy. Count 3 was dismissed before the jury got the case because the judge felt prosecutors did not provide enough proof.

Baumgartner faces 1-3 years behind bars and a $250,000 fine for each count. The judge will sentence him on March 27 at 9 am.
