Casey Anthony re-files request to throw out punitive damages

Attorneys for Casey Anthony are again seeking to limit the damages Zenaida Gonzalez can pursue in her civil defamation lawsuit.

Circuit Judge Lisa Munyon denied Anthony's previous attempt to throw out Gonzalez's claim for punitive damages, ruling that defense attorney Charles Greene hadn't filed the proper type of motion. Munyon left open the possibility of Greene refiling his pleading, and the defense did that last week.

"Based on, among other things, the fact that neither party knew the other, had a history of ill will towards the other, or was otherwise even aware of the other's existence, [Gonzalez] cannot present sufficient evidence to satisfy the specific and mandatory requirements" for pursuing punitive damages, the new motion says.

I don't know the answer to your question, Toronto, but

I'll look and do a thread with links if I find any.

The civil trial was delayed so that KC could not claim the 5th while her apeal in criminal conviction is still pending.

The appeal set for 8th January according to what I have read.

Don't know about the Civil Hearing still. But my guess is it might well be streamed live??

Zenaida's Bankruptcy attorney, R Scott Shuker, filed a Motion to Transfer the bankruptcy case to Orlando [from Tampa], on Feb 5, 2013. A Hearing on this Motion was set for Feb 26, 2013.

Casey's Bankruptcy attorney, David L. Schrader, wants the Hearing scheduled for
Tuesday Feb. 26, 2013, at 9:30am, postponed because he has another case Final Evidentiary Hearing on the same day and not enough time to prepare for Zenaida's Motion to Transfer Hearing or to file his Response to the Motion to Transfer.

Attorney Schrader says he has to be in another case Hearing on Mirabilis Ventures, Inc. on the same day and the Mirabilis Evidentiary Hearing cannot be rescheduled because it has already been rescheduled twice before.

Schrader also says he previously had assistance from co-counsel in the Mirabilis case, but no longer has that assistance and will have to do all the prep work himself.

Schrader also says that his close friend's mother passed away last week and service was on Friday Feb 22, 2013. With the funeral and other matters, Schrader has been unable to devote time for preparation of Casey's Response to the Zenaida Motion to Transfer to Orlando, and no time to prepare for the Mirabilis Final Hearing scheduled for Feb 26, 2013.

Schrader says the Bankruptcy court has 14 other scheduled hearings for
Feb 26, 2013, along with Zenaida's hearing on Motion to transfer to Orlando.

Schrader wants Zenaida's Motion to Transfer to Orlando re-scheduled to a later date, and also wants the March 4, 2013 Meeting of Creditors also rescheduled until after the Hearing is held on the Motion to Transfer to Orlando.

Casey Anthony defamation trial may happen before bankruptcy filing decided
Zenaida Gonzalez suing Anthony for defamation

TAMPA, Fla. —Zenaida Gonzalez' defamation lawsuit against Casey Anthony will most likely go to trial before her bankruptcy filing is addressed.

On Monday, Gonzalez' lawyers filed a motion asking for more time to object to Anthony's bankruptcy after the defamation case goes before an Orange County jury.

The bankruptcy judge suggested the two sides try the case first to see if a jury awards Gonzalez any money damages.

That would help determine whether Gonzalez could still claim to be Anthony's creditor in the future bankruptcy action.

Casey Anthony civil trial must go on before bankruptcy case

ORLANDO -- Casey Anthony will have to head back to civil court after a bankruptcy judge ruled Tuesday that a jury needs to decide if she ruined the reputations of Zenaida Gonzalez and meter reader Roy Kronk.

Attorneys for Zenaida Gonzalez said they are now working to get a new trial date set.

Casey Anthony's civil trial was put on hold when she filed for bankruptcy in January. But at a hearing Tuesday, a bankruptcy judge said the case needs to get figured out in civil court first, to see if there even is a case for bankruptcy.

Zenaida Gonzalez claimed her life was ruined with Anthony said a nanny with the same name kidnapped her 2-year-old daughter, Caylee. Anthony's lawyers later admitted there was no nanny.

Charade needs to end, Anthony says

ORLANDO, Fla. —In a new court filing, Casey Anthony is accusing the woman suing her for defamation, Zenaida Gonzalez, of fraudulently masquerading as the so-called "Zanny the Nanny."

The filing comes in opposition to a motion by Gonzalez' team for more time to fight Anthony's bankruptcy case, should the two sides decide to resolve the defamation case in state court first.

In that filing, Anthony accuses the woman suing her of masquerading as Zenaida "Fernandez" Gonzalez, to perpetuate her pursuit of money damages against Anthony.

Anthony's attorney writes, "It's time for this charade to end."

The two sides are back in bankruptcy court in Tampa Wednesday afternoon.

As far as I know, being totally incapable of telling the truth even to save her miserable life is not yet recognized as a legal defense. However, by the time this trial is over, we can bet the issue will be thoroughly examined.

Things get heated between lawyers at Casey Anthony bankruptcy hearing

During a federal court hearing Thursday Oct. 17, Judge K. Rodney May decided to delay making a decision as to whether Casey Anthony will have to sit for depositions with lawyers representing Zenaida Gonzalez.

Gonzalez, a woman by the same name as the nanny Casey Anthony told investigators kidnapped her child, is suing Anthony for defamation. Attorneys for Gonzalez scheduled a deposition with Anthony for last week however, the deposition was put on hold after Anthony's lawyers filed a Motion for Protective Order.

It states Anthony should not be subjected to a deposition until after the next scheduled hearing on Nov. 5th. The judge will hear their Motion to Dismiss and decide if he will continue or dismiss Gonzalez's case.

Attorneys David Schrader and Debra Ferwerda told Judge May that the attorneys for Gonzalez scheduled the deposition without consulting with them about security concerns they have for their client, dates, times or a location.

Gonzalez's attorney, Scott Shuker said that members of Anthony's legal team kept advising him to call and arrange things with another member of the team and eventually referred him to Charles Green (Anthony's civil attorney). Green has not filed a notice of appearance for Anthony's bankruptcy case. Judge May reprimanded both sides saying he wanted to know what they have worked together to accomplish, adding he didn't want to know what they hadn't.

TAMPA, Fla. —A judge has denied a motion by Casey Anthony to dismiss the two civil defamation suits against her in federal court.

The judge's ruling opens back up the possibility that Anthony will have to be deposed, because she will be unable to plead the fifth in a civil case.
