Casey Anthony files motion to change venue in civil trial

Attorneys for Casey Anthony have filed two dozen pages of documents this week seeking to have her upcoming civil defamation trial moved out of Orange County, arguing she'll never get an impartial jury here.

In the paperwork, Anthony's attorneys argue pretrial publicity "has had an undue influence" in Orange County, "and the bias against Ms. Anthony is so odious that it would be impossible for her to receive a fair trial.

The lawsuit, brought by Zenaida Gonzalez, is set for trial in January. Gonzalez says her life was upended after Anthony told authorities a similarly named nanny had kidnapped her daughter.

Anthony's lawyers cite extensive coverage of the death of the girl, 2-year-old Caylee, and the murder trial that followed. Though Anthony was cleared of all major charges, "the local media refuses to move on," her defense says.

As a result, "the overwhelming opinion of the public, especially in Orange County... is that justice was not served in the Criminal Case," they argue.

Casey Anthony's attorneys on Tuesday made their case for moving her upcoming civil defamation trial out of Orlando, but a hearing on the issue ended without a ruling.

After a brief hearing, Circuit Judge Lisa Munyon said she'd issue a written ruling on the request later.

Anthony's lawyer Charles Greene argued it's an "impossibility, I submit, that Ms. Anthony can get a fair trial in Orange County."

"We had hoped that the publicity in this case would subside after the criminal case," he said. "It has not."

He cited a weekend story in the Orlando Sentinel about the hearing as evidence media attention has not waned.

Meanwhile, Gonzalez's lawyers have filed a motion asking Munyon to allow them to question Anthony about audio recordings they say she made.

Anthony referenced the recordings in a video diary that leaked online in January. Gonzalez's team wants them, but Anthony's lawyers say they don't have them.

Gonzalez wants "to determine what has happened to the audio tape(s) and if they have been destroyed after the request was made," her new motion says.

Where will Zenaida Gonzalez’s defamation suit against Casey Anthony be heard?

The attorneys for both sides argued the change-of-venue issue Tuesday. Gonzalez says her life was ruined when she was linked to the disappearance of Caylee Anthony. Casey Anthony was acquitted of murder last year in the death of her daughter.

At noon Tuesday, WESH-Channel 2’s Bob Kealing reported that Anthony’s attorneys want the civil trial moved north and listed the order of their preferences: Tallahassee, Jacksonville or Pensacola.

Kealing focused on an irony in the change-of-venue issue. “It’s interesting that Anthony’s defense team, after so hard and so long trying to distance themselves from the criminal case, they said that Judge Belvin Perry’s ruling on the venue issue from the criminal trial still holds here,” Kealing said. “He said that Casey Anthony could not get a fair trial from the citizens of Orange County. There’s just been too much publicity.”

And that still was true, Anthony’s attorneys said. Gonzalez’s attorneys raised one issue.

“Gonzalez’s lawyers say if it’s moved, Casey should pick up the tab, not the taxpayers, even if Casey claims to be broke,” WFTV-Channel 9 anchor Vanessa Echols said.

“If she claims poor, poor me, then our position is then it ought to be here. You shouldn’t be able to pass that tab off to other people,” Gonzalez attorney Keith Mitnik said.

Judge Lisa Munyon will issue a written order on the change of venue. The trial is set for Jan. 2.

Casey Anthony's lawyers: Don't let Zenaida Gonzalez claim lost wages at civil trial

Attorneys for Casey Anthony on Friday filed the latest in a series of motions aimed at keeping evidence or testimony out of her upcoming civil defamation trial, currently set for early January.

This time, Anthony's team wants to bar Zenaida Gonzalez and her attorneys from presenting any testimony or argument that Anthony caused Gonzalez to lose her job or any wages.

Gonzalez, the defense says, "falsely claimed her lack of employment was the result of statements made by Casey Anthony."

"The truth is that [Gonzalez] has rarely been employed and has subsisted on food stamps and other government assistance for most of her life," the new motion by Anthony's defense states.

Casey Anthony can be questioned about audio tapes, judge says

Casey Anthony will have to answer questions about what happened to audio recordings she made after her murder acquittal last year, a judge in her defamation suit ruled Tuesday.

Anthony mentioned the recordings in a video diary she made which leaked online in January. Attorneys for Zenaida Gonzalez, who is suing Anthony, hope the audio may be relevant to their suit.

The judge previously conditionally granted Gonzalez's request for the audio tapes, but Anthony's lawyers responded that they don't exist.

At a hearing Tuesday, Anthony's attorney Charles Greene for the first time gave a detailed account of what came of the audio, as well as additional video diaries Anthony made.

Greene said Anthony "was spending a lot of time in isolation" while living in hiding late last year. Her lawyers told her it might be "therapeutic" to make a record of her thoughts, Greene said.

He said the advice was "consistent with the advice of psychotherapists."

Judge denies Casey Anthony's request to move civil trial

When Casey Anthony goes to trial in her civil defamation lawsuit, it will be at the same courthouse where she was acquitted of murder last year, a judge ruled today.

Circuit Judge Lisa Munyon has denied Anthony's request to move her trial away from Orlando. But her ruling allows the parties to revisit the issue if difficulties arise in jury selection.

The ruling comes a week after Anthony's attorney, Charles Greene, aruged at a hearing that it's an "impossibility, I submit, that Ms. Anthony can get a fair trial in Orange County."

He argued the jury pool would be better somewhere "north of Orlando," such as Tallahassee or Gainesville.

Casey Anthony attorneys back in court over civil case

ORLANDO, Fla. —

Attorneys for Casey Anthony and Zenaida Gonzalez will be back in court Wednesday afternoon for another hearing.

Anthony’s lawyers are trying to limit the amount of money a jury could award Gonzalez in the civil case.

Gonzalez is suing Anthony for defamation after Anthony told detectives a woman with the same name kidnapped her daughter, Caylee.

The trial is set for January.

On Tuesday, the judge ruled against Anthony’s request for a change of venue.

Anthony wants punitive damages tossed from suit

Casey Anthony’s civil attorneys asked a judge Monday to throw out punitive damages in a defamation lawsuit filed against their client by Zenaida Gonzalez.

Punitive damages are different than compensatory damages. Compensatory damages are meant to compensate a plaintiff after a loss caused by the defendant. Punitive damages go above and beyond that in certain circumstances to punish the defendant and are meant to prevent the behavior in the future.

In 2009, when the punitive claim was approved by the former judge, 2008 statements made by Anthony to law enforcement were admissible.

However, the current judge threw those comments out, ruling them inadmissible. Now Anthony's attorneys say the only remaining evidence in the defamation suit is a 15-second statement Anthony made to her mother about Gonzalez in a recorded jail conversation.

In the motion filed Monday, Anthony’s defense attorneys also list the many differences between Zenaida Gonzalez, the plaintiff, and Zenaida Fernandez-Gonzalez, the fictional nanny. The differences include nicknames (Bebe vs. Zanny), ethnicity (Puerto Rican vs. a mix of black and Hispanic parents), and tattoos (many vs. none.)

Earlier this month, both parties agreed to not mention Anthony’s criminal trail during the civil trial, because it might be too prejudicial.

Attorneys for Casey Anthony were back in court on Wednesday in an attempt to limit the damages she could be ordered to pay in the defamation lawsuit set for trial early next year.

After a half-hour hearing, Circuit Judge Lisa Munyon did not rule on whether Zenaida Gonzalez should be able to pursue punitive damages. The judge plans to issue a written ruling later.

Zenaida Gonzalez witness list: Casey Anthony, the cops and TV reporters

Zenaida Gonzalez's lawyers have filed a new witness list in their civil defamation suit against Casey Anthony, including Anthony, her parents and local television reporters.

Gonzalez's attorneys agreed to pare down their list after Anthony's lawyers complained that about 90 people had been identified as potential witnesses.

The new list, under the judge's order, was to contain only "those witnesses [Gonzalez] intends to call at trial."

The suit is set for trial in Orlando in early January. Casey Anthony, now 26, was acquitted on all major charges in the death of her daughter at trial last year.

Anthony's motion to throw out punitive damage claim denied by judge

ORLANDO, Fla. —

A judge issued an order denying Casey Anthony's request to limit the amount of damages she could pay in the defamation trial with Zenaida Gonzalez.

Anthony's attorneys argued that the case does not meet Gonzalez's claim for punitive damages.

Judge Lisa Munyon denied the claim in an order issued Friday.

Last week, Munyon also denied a motion to change the venue for the civil trial. She would "revisit the issue if a fair and impartial jury cannot be selected in Orange County within a reasonable time."

An Orange County judge ruled Friday there will be no limit on what Casey Anthony could be ordered to pay in the defamation lawsuit involving Zenaida Gonzalez.

Anthony's attorneys had asked that the jury be banned from ordering her to pay punitive damages.

Circuit court judge Lisa Munyon ruled Anthony's attorneys didn't file the right motion.

Gonzalez is suing Anthony for defamation after Anthony told detectives a woman with the same name kidnapped her daughter, Caylee.

Anthony is afraid her civil trial could take away hundreds of thousands of dollars she could earn in future book or movie deals, so her lawyers fought to convince a judge not to allow Gonzalez to sue Anthony for punitive damages, according to Channel 9's Kathi Belich.

Last year a jury acquitted Anthony of murder after she claimed Caylee drowned.

The first judge on the case already ruled the jury could consider punitive damages. The second judge said she'll rule in writing whether to reverse the order.

WFTV's legal analyst said the civil jury's verdict might not go Anthony's way.

"It's human nature," Sheaffer said. "No one wants to believe that someone got away with murder without being punished. There may be a chance to mete out that punishment."

Casey Anthony is required to show up in person to face allegations of defamation in Zenaida Gonzalez's civil lawsuit against her, but RadarOnline.com has exclusively learned the 'Tot Mom' plans to plead the fifth.

Casey, 26, has been fighting hard to not have to appear in the courthouse for the trial, and according to a pal of her brother, Lee Anthony, if she does have to appear she doesn't plan on testifying.

"Lee will have to testify, but Casey is hoping she'll find a way out of it," the insider said.

"She wants to just show up to court for one day, plead the fifth, and then never have to go back to the courthouse."

However, because Casey is appealing her lying convictions — which will be heard separately — the only way she will be able to plead the fifth is if those convictions get overturned, otherwise she won't have that option.

Motion filed to reschedule Casey Anthony's civil trial

Casey Anthony's civil trial in a defamation lawsuit is set for January, but on Tuesday, attorneys for Zenaida Gonzalez filed a motion to reschedule the trial to a later date. Casey Anthony's attorney, Charles Greene, says he wants to keep the current trial date for January 2 and has been working hard to file motions based on that date.

This is all about timing. Greene says the appeal in Casey's criminal case is scheduled for court on January 8, six days after the civil trial. The defense is appealing the criminal conviction that Casey lied to officers, by telling them her daughter Caylee was kidnapped. Because of the appeal, Casey is protected from talking about the case under the Fifth Amendment, as her criminal trial takes place.

According to the motion by attorneys for Gonzalez, the plaintiffs want to wait until the criminal appeal is resolved before moving on to their civil case.

As much as I frustrated by all trials that drag on... this seems like an EXCELLENT move to me.

KC is managing to HIDE behind the 5th amendment in the civil case... by claiming the 5th while she has the appeal pending.
The appeal itself is nonsense... the conviction for lying was correct and is done and gone anyway.

I think the criminal appeal should run it's course first... then KC can be compelled to answer questions in the civil case.

Not that I expect her to tell the truth :13

How do you like it when reporters become part of the story?

Casey Anthony’s attorney, Charles Greene, has filed notice that he plans to depose WFTV-Channel 9’s Kathi Belich and WESH-Channel 2’s Michelle Meredith on Nov. 28 in the Zenaida Gonzalez civil suit.

According to Gonzalez’s witness list, she wants Belich to testify at trial on the “degree of media coverage surrounding the search for Zenaida Gonzalez.”

Meredith is supposed to testify on her “first interview with” Gonzalez.

What happens next?

“We haven’t been served, but as I said before, we’ll fight that one,” said WFTV news director Matt Parcell.

“We/she has not yet received a subpoena,” WESH news director Bob Longo said of Meredith.

Judge approves delay for Casey Anthony's defamation trial
No date was set for lawsuit filed by Zenaida Gonzalez

Attorneys for Zenaida Gonzalez, the Kissimmee woman suing Casey Anthony for defamation, successfully argued Friday to delay the civil trial.

No new trial date was set, but attorneys and Orange County Circuit Court Judge Lisa Munyon agreed to hold a pretrial conference in the spring.

Gonzalez's lawyers wanted the trial delayed because they don't want Anthony to rely on the Fifth Amendment to avoid their questions because of her ongoing criminal appeal of her lying to law-enforcement convictions.
