ORANGE COUNTY, Fla. (WOFL FOX 35 ORLANDO) - A status hearing for Casey Anthony's civil suit takes place on Tuesday morning. Even though the woman suing Casey was recently arrested, defense attorneys say it won't sway the case either way, because they think the evidence is weak.

Meanwhile, as Casey enjoys total freedom now that she's off probation, Charles says, there's a chance she will have to come back to Orlando, "If a trial occurs she may have to be there for part of it." He won't say where Casey is living now.

The status hearing takes place at 8:30 Tuesday morning. If the civil trial goes to court, it's expected to take place on January 2nd of next year.

The "appeal" against her lying convictions is still ongoing.... so an EXCUSE to not testify.

I HOPE KC is punished financially in this and any other suit against her... but the ZFG suit has never seemed that strong to me.

Casey Anthony must turn over info on her finances, judge says

Did Casey Anthony get money from her parents' trust fund? After a ruling Tuesday, Anthony will have to tell Zenaida Gonzalez the answer, but the public won't find out at least until the case goes to trial.

Gonzalez's lawyers wanted to know if Anthony's parents, George and Cindy, have been funneling her money from the trust fund they created in honor of their granddaughter, Caylee Marie. Anthony's attorneys argued that was "private financial information" and irrelevant to the ongoing civil suit.

At a hearing Tuesday, Gonzalez's attorneys said that because they're seeking punitive damages against Anthony, they must know everything they can about her net worth. They said their fear was that Anthony would argue at trial that she's broke.

"We assume that they will take that position in the case," said Gonzalez attorney John Dill.

Anthony's attorney, Andrew Chmelir, countered that Gonzalez was only looking for publicity. The source of any funds Anthony has received, he said, isn't necessary to determine how much money she has.

"They're asking for information above or beyond what her net worth is," Chmelir said.

The judge ruled in favor of Gonzalez, with a caveat: Anthony must answer Gonzalez's questions, but her attorneys may not reveal the answers publicly other than in open court at trial. The trial is currently scheduled for January.

The judge also heard argument about Anthony's so-called "video diary," which leaked online in January. In it, Anthony made reference to other audio recordings she had made. Gonzalez's team told the judge they want those recordings. If Anthony was keeping a record of her thoughts, they argued, it's reasonable the subject of her daughter's death could have come up.

With a January trial looming in the defamation lawsuit brought by Zenaida Gonzalez, attorneys for Casey Anthony want a judge to block any testimony or evidence related to the last time their client was in court — for her murder trial.

In a motion filed late last week, Anthony's attorneys ask Circuit Judge Lisa Munyon to block "any evidence, comment, or other reference by counsel of any witness in this case concerning" Anthony's highly publicized murder prosecution and trial.

Gonzalez, Anthony's team argues, "should be barred from presenting any evidence or making any argument concerning the criminal proceedings."

Anthony's defense team also filed a second motion asking the judge to compel Gonzalez's lawyers to reduce the number of people on their witness list to "only those persons who might have knowledge of the facts relevant to the case." The latest version of the list, Anthony's team says, included 89 names, and failed to specify what each witness would testify about.

An attorney for Gonzalez didn't immediately respond to a call seeking comment Wednesday.

Gonzalez legal team reacts to new Anthony motion
Anthony's lawyers seek to ban mention of criminal trial

ORLANDO, Fla. —Casey Anthony's legal team said in a new motion that they want the judge to ban any reference to her now closed criminal cases during her upcoming civil trial.

Attorneys for Zenaida Gonzalez told WESH 2 they don't plan to bring up Anthony's murder trial in court, but they do intend to call as witnesses who were part of the criminal trial to prove Anthony defamed their client.

Attorney John Dill said the witnesses include Anthony's parents and brother, Lee, plus the lead Orange County detectives in the murder case, John Allen and Yuri Melich.

Casey Anthony's attorneys have requested to ban evidence of her murder trial in her upcoming defamation case against Zenaida Gonzalez. Gonzalez's attorney, Matt Morgan told In Session's Vinnie Politan that Anthony's request is 'much ado about nothing.'

"To think or believe that a resident of Orange County would not be aware of what was going on in the criminal trial is just not reasonable," said Morgan.

Morgan also ensured Politan that "no question about it...[Anthony] will be there," and might even have to testify for the first time.

Gonzalez is suing Anthony for defamation and claims she was harassed and threatened after Anthony came up with a fictitious nanny named Zenaida Gonzalez-Fernandez, also known as "Zanny the Nanny." Anthony accused the fictitious nanny of kidnapping her daughter, Caylee.

I would love to hear her BS and reveal her real BS self

I think ALL the zenaidas gonzalez (whatever etc ) should be suing the ass of her only this one has some justification re the sawgrass apartment card

Also the ppl down the road where the Zeniadas and the Gonzalez ppl live near where Caylees remains where found RIP Caylee

One of the week’s more head-scratching stories didn’t receive a lot of coverage.

At Zenaida Gonzalez’s defamation trial, Casey Anthony’s attorneys want no mention of media reports about Caylee Anthony’s death or Casey’s murder trial. Anthony’s attorneys filed the motion this week.

Can’t you see Seth Meyers on “Saturday Night Live” taking up that bit of news and going, “Really?”

Zenaida Gonzalez attorneys agree to trim witnesses list in Casey Anthony lawsuit

Attorneys for Zenaida Gonzalez have agreed to pare down their witness list to only those likely to testify when her civil defamation lawsuit against Casey Anthony goes to trial in January.

Meanwhile, Gonzalez's lawyers in separate court filings attacked recent motions by Anthony's defense seeking to prevent jurors in the civil case from hearing about Anthony's murder prosecution in her daughter's death.

Anthony's lawyers had complained that about 90 people had been listed as potential witnesses by Gonzalez, including people Anthony's team said were unlikely to have relevant information.

A new order, agreed to by both sides, directs Gonzalez's lawyers with the Morgan & Morgan firm to limit their witness list to "only those witnesses she intends to call at trial."

Gonzalez's attorneys will also "provide a description for each witness" and "summarize the facts to which each witness is anticipated to testify," says the order, signed by Judge Lisa Munyon.

Casey Anthony's attorneys ask for change in venue for civil case

ORANGE COUNTY, Fla. —
WFTV learned Monday Casey Anthony is asking for a change of venue in her civil case.

In the court motion WFTV obtained Thursday night, Anthony's attorneys claim she can't get a fair trial in Orange County, and that Gonzalez's legal team admitted that on television.

A hearing on the motion is set for Wednesday.

Attorneys for Zenaida Gonzalez agreed in principle on Thursday to not mention Casey Anthony's murder trial during her upcoming defamation trial, if they can avoid it.

However, the murder trial could be mentioned on specific topics individually approved by the judge, such as to challenge the testimony of witnesses.

Anthony's murder trial was among the most talked-about in Central Florida's history. So her lawyers wanted the judge to block any mention of that notorious case from her upcoming trial in Gonzalez's defamation lawsuit.

Attorneys for Anthony and Gonzalez discussed that issue Thursday morning at the Orange County Courthouse, and the two parties largely agreed — something they haven't done often in the hard-fought suit.

"I don't foresee us in a civil case saying, 'X, Y and Z happened in the criminal case,'" Gonzalez attorney John Dill said.

Anthony's attorney Charles Greene, meanwhile, acknowledged that "there may be points where something about the criminal proceedings come up indirectly."

The parties agreed that they would have to bring up the murder trial during jury selection, in order to determine the extent of jurors' knowledge of the case. After that, any references will have to be cleared by the judge.

In their motion, Anthony's attorneys had asked Circuit Judge Lisa Munyon to block "any evidence, comment, or other reference by counsel of any witness in this case concerning" Anthony's highly publicized murder prosecution and trial.

Attorneys for Casey Anthony in a pair of new court filings continue their attempt to limit testimony in her upcoming civil defamation trial, and also to limit the amount of money Anthony could be ordered to pay if she loses.

In a new motion filed Monday, Anthony's lawyers ask the judge to throw out Zenaida Gonzalez's claim for punitive damages — essentially, an additional penalty meant to punish Anthony.

Based on the evidence and argument presented in the lawsuit so far, "there is insufficient evidence to support a claim that Ms. Anthony is personally guilty of intentional misconduct or gross negligence," Anthony's defense says.

Casey Anthony asks judge: Don't let Zenaida Gonzalez mention search for Caylee at civil trial

Casey Anthony's attorneys this week continued their effort to limit damaging testimony in her upcoming defamation trial, asking a judge to bar from the suit any reference to the search for her daughter, Caylee Marie.

The new defense motion asks Circuit Judge Lisa Munyon to prevent any evidence or testimony concerning search efforts "by any person or entity, including... law enforcement, Texas EquuSearch, [or] independent volunteers."

"The search efforts for Caylee Anthony are not relevant to any issue in this case," Anthony's lawyers argue, adding that "at most" Gonzalez's lawyers "may argue that Caylee Anthony was 'missing' in August of 2008."

The request is the latest in a series of motions based on a decision by Munyon in April, which threw out much of the lawsuit. What remains is based on a jailhouse visit by Anthony's parents to their daughter.

Anthony by then had told detectives that Gonzalez wasn't the nanny. But she told her parents during their visit that Gonzalez had not been ruled out, and her mother relayed that to the media, keeping Gonzalez in the firestorm.

Based on Munyon's ruling in April, Anthony's lawyers have since sought to chip away at the lawsuit. Recently, the judge granted a request to largely preclude references to Anthony's murder case from the lawsuit.
