I mis-labeled this thread. The appeal is over the lying convictions.. and still ongoing
No doubt a ploy to avoid testifying at Civil Trials.

State files response to Casey Anthony's appeal

The State of Florida filed its answer on Thursday to Casey Anthony's appeal of her convictions for lying to law enforcement officers about the death of her daughter, Caylee Marie.

Anthony has appealed her four misdemeanor convictions and asked for a new trial.

The next step in the appeal is for the Anthony team to reply to the paperwork filed by the state on Thursday. That reply is due in 25 days. After that, the case will be set for oral argument before the Fifth District Court of Appeal in Daytona Beach.

Anthony's appeal is based on three issues:
  • Jurors shouldn't have heard testimony about Anthony's lies, her defense argued, because she hadn't been advised of her rights, despite having been briefly handcuffed and put in a deputy's vehicle, before she was questioned by detectives.
  • Anthony's attorneys argue that her four convictions violate the constitutional double-jeopardy protection. The four lies she was charged with, they say, were really just one "single offense."
  • The defense also argues Perry incorrectly ruled against an objection to part of the jury instructions about perjury, rendering the only charges Anthony was ultimately convicted on "unconstitutionally vague."

In its answer, filed Thursday, the state countered that Anthony was not officially in custody when she lied to investigators and her appellate brief "failed to show a double jeopardy violation" or prove an issue with the instructions.

The appeal has a substantial impact on several lawsuits Anthony faces in connection with her daughter's death, including a defamation suit brought by Zenaida Gonzalez, who says she was defamed when Anthony told authorities a nanny with a similar name had kidnapped Caylee.

Anthony has cited her pending appeal to avoid answering questions about her daughter's death in that suit, which is currently set for trial in Jan. 2. A spokeswoman for the DCA said Thursday it appears unlikely the appeal will conclude before then.

This appeal and the stalling on it seems to be to be just a ploy.... an excuse for KC to not answer questions in various civil suit hearings.

It seems to be working.

Costing the tax-payers of Florida yet more... and somehow KC gets funded... at least partially by tax-payers as well.

It seems nuts to me.

Appellate court sets date to hear Casey Anthony's appeal on misdemeanor convictions

An appeal court in Daytona Beach is now scheduled to hear Casey Anthony's appeal of her four convictions for lying to law enforcement early next year, after her legal team today filed the last paperwork necessary to proceed.

Oral arguments in the appeal have been scheduled for Jan. 8, just days after the trial in a defamation suit against Anthony is set to commence.

The lawsuit, brought by Zenaida Gonzalez, is set for trial Jan. 2. Gonzalez's lawyers have been hamstrung by Anthony's appeal — she cited it to avoid answering questions — and hoped it would conclude before trial in the suit.

Attorneys for Anthony filed their reply to the state's argument in her appeal on Monday, the last filing necessary from either party before the case could be heard by the Fifth District Court of Appeal.

The jury that acquitted her of murder agreed that she broke the law when

1. she told police she worked at Universal Studios,
2. that she left her daughter with a babysitter named Zenaida Fernandez-Gonzalez,
3. when she claimed that Caylee was missing,
4. when she claimed that Caylee was still alive and she had spoken to her on the phone July 15, 2008.

None of those statements were true.

umm and what do those jurors Think the truth was if these were lies? and they found her guilty of these lies and even her lawyer admitted they where lies so i can't understand on what grounds an appeal is likely to be a positive outcome for the anthony bitch

illogical conclusion to the trial

Anthony’s appeal of her conviction of lying to law enforcement will be heard Jan. 8. She was acquitted of murder in the 2008 death of her daughter.

Anthony’s legal team warned that the appeal process could go far longer and that the Gonzalez trial could “drag into 2014,” Kealing reported. Gonzalez’s lawyers want to question Anthony after the appeal ends, when she could no longer cite the Fifth Amendment in avoiding questions.

Case Against Casey returns to court Tuesday

ORLANDO --

The Case Against Casey is heading back to court Tuesday as the Fifth District Court of Appeals is scheduled to hear arguments surrounding her appeals.

Anthony is trying to have her four convictions of lying to law enforcement officers overturned.

Her lawyers are arguing that the convictions violate double jeopardy protection.

They said the four lies she was convicted of, was really just a single offense.

Anthony is not expected to be in court Tuesday and will instead be represented by her attorneys.

News 13 will bring you live coverage of Tuesday’s appeal hearing beginning at 1:30 p.m.

ORLANDO -- The Case Against Casey Anthony heads back to court this week.

Anthony's lawyer will ask a state appeals court to throw out her convictions for lying to the police.

The jury in her murder trial convicted her on four charges of lying to law enforcement.

Anthony's lawyer says it should only be one charge because it's otherwise considered double jeopardy.

The outcome of this hearing could also decide if Anthony will have to testify in another trial.

She's refused to answer questions in a defamation lawsuit filed by Zenaida Gonzalez.

Her lawyer says any answers could jeopardize her appeal, which prompted Gonzalez's lawyers to have their trial delayed until after the appeal.

Anthony is not expected to be in court for Tuesday's hearing in Daytona Beach.
