I did think this was the CORRECT result.. and was tempted to get up at 2:00AM to see it announced.... but there is always that lingering doubt that even a Judge will get it wrong!!

In my opinion Marilyn Mosby is guilty of malicious prosecution and should be disbarred.

I wonder if the other defendants will take a clue and demand bench trials.

Mosby is obviously out of her depth(thick) as well as biased and dishonest. Unfortunately it's not been uncommon in prosecutors that I have followed through cases.

I think there are occasions when a Jury trial is better.... it is good that the defendant gets the choice.

It's a strategy decision for Defense. They have to weigh up what they think they can do to play on a jury. Which Judge is (unfortunately) a factor too.

Normally a jury trial is the best way to go as you argue the law but more importantly a good attorney will manipulate emotions. Remember that rat bastard Nel and his emotional appeal? Juries are susceptible to emotion whereas judges even corrupt or activists judges are loathed to be made a fool of.

To quote the late Antonin Scalia “Understand that reason is paramount with judges and that overt appeal to their emotions is resented. The reason is rooted in the nature of what we typically think of as “jury argument” — a blatant appeal to sympathy or other emotions, as opposed to logical application of the law to facts. Before judges such an appeal should be avoided.”

…. You are fortunate if the jude will attribute such misconduct to your ignorance rather than the vulnerability of your case”


In this case when it is an obvious malicious prosecution and under the scrutiny of the public, I would choose a bench trial. Any judge who finds any of these officers "guilty" will have their moment of glory with the idiots like Mosby Minions but their reputation will be forever sullied and they will be a laughingstock behind closed doors amongst their peers and colleagues. I just don't see a judge putting themselves through that humiliation just to have their judgment eventually overturned.

Mayor Stephanie Rawlings-Blake is a disgusting racist, opportunistic scum bag. I suspect she is trying to keep the youngsters from rioting again.

I hope the officers sue her, Mosby & Baltimore for Malicious prosecution.

Williams is an activist judge, he will do anything he can to advance the cause.

Malicious Prosecution

An action for damages brought by one against whom a civil suit or criminal proceeding has been unsuccessfully commenced without Probable Cause and for a purpose other than that of bringing the alleged offender to justice.



Elements of Proof

To win a suit for malicious prosecution, the plaintiff must prove four elements: (1) that the original case was terminated in favor of the plaintiff (2) that the defendant played an active role in the original case (3) that the defendant did not have probable cause or reasonable grounds to support the original case and (4) that the defendant initiated or continued the initial case with an improper purpose Each of these elements presents a challenge to the plaintiff.





Seems to me that every box is checked for Officer Nero's civil suit.

Sad answer is they can't. That money is as gone as if they shook it out of pillowcases from a mountaintop.

I don't know what the terms of the settlement were but I'm sure it is ironclad.
