Officer Caesar Goodson trial day 6: What you need to know

What happened Thursday?
  • Tensions between police and prosecutors erupted, with a top prosecutor accusing a lead detective of trying to sabotage the state's case against six officers.
  • Chief Deputy State's Attorney Michael Schatzow also suggested that top police officials tried to persuade the doctor who performed Gray's autopsy to rule his death an accident rather than a homicide.
  • Detective Dawnyell Taylor, lead detective in the police investigation of Gray's death, denied the claims and in turn suggested that Deputy State's Attorney Janice Bledsoe lacked integrity and was dismissive of evidence in the case.
  • The judge denied a motion to dismiss the charges, but only after expressing "concern" about the merits of the murder charge.
  • The day ended with testimony from Donta Allen, the second arrestee placed in the van with Gray. He said he could not recall the day he and Gray were arrested until a video of his statement to police was played. Afterward, he was cooperative with prosecutors, who suggested he'd provided inaccurate information in the interview because he was high on heroin and Xanax, didn't trust the police and offered information they wanted to hear in order to be released from custody without charges.

In new filing yesterday, Goodson asked judge to allow prosecutor's closing argument in Nero trial to be admitted as evidence in his trial.

Specifically, Goodson wants Schatzow's comments about Nero, other officers having custody of Gray to be admitted:

Def 8th witness: Det. Patty Bauer, gave in-service training re fleet safety to Goodson in 2013. Says did not incl seat belting passengers.

Prosecutor Bledsoe on cross: Isn't it "fair to say that it's just COMMON SENSE" to seat belt passengers?? Defense objected, judge sustained.

Judge Williams just struck ALL of Bauer's testimony, after she acknowledged that she wasn't sure she was the one who taught Goodson.

Officer Nero, acquitted last month, has indeed taken the stand as a defense witness in Officer Goodson's trial.

Defense questions very limited. They basically had Nero testify that Gray was being combative, banging in van at second stop. That's it.

In turn, prosecution had very limited cross. Nero is already off the stand.

Judge Williams denies the Goodson defense motion to bring in statements made by prosecutor Schatzow in closing of Nero's trial.

What happened Friday?
  • Defense rested. Closing arguments in the trial of Officer Caesar Goodson Jr., charged in the death of Freddie Gray, will begin Monday at 10 a.m. after seven days of testimony.
  • Nero testified -- briefly. Goodson's defense asked him about Gray's demeanor at the second stop of the van in which Gray was injured. Nero said Gray was combative with officers and that he heard "loud banging" coming from the van where Gray was placed alone.
  • Williams denied a motion filed Thursday by Goodson's attorneys to allow as evidence in Goodson's trial statements made by Chief Deputy State’s Attorney Michael Schatzow during closing arguments in Nero's trial last month.
  • Goodson elected not to testify.
  • Det. Patty Bauer, a police expert who gave in-service traffic safety training to police, also testified. Bauer's testimony was struck by Williams after acknowleging she was unsure if she was the one who taught Goodson in 2013.

Sorry but what kind of bullshit is that? Really? If Judge Williams is going over the evidence with due diligence how can he know that it is going to take him 3 more days to render a verdict?

Two things come to mind 1) Williams hand is being forced into some kind of guilty plea or 2) William's is going to render a not guilty verdict and the city is getting ready for the Sons of Obama to riot.

I think it's the latter as well. I also believe most people will realize an acquittal in this case dooms all the other cases so riots are far more possible this time around.

Hi ALL ~ :)

After some thought, this case is really not as simple as I first speculated regarding the outcome of acquittal on all charges.

Goodson is the most charged officer.

CHARGES
Second-degree depraved heart murder
Involuntary manslaughter
Second-degree negligent assault
Manslaughter by vehicle and gross negligence
Manslaughter by vehicle criminal negligence
Misconduct in office for failure to perform a duty regarding the safety of a prisoner
Reckless endangerment

Here's the chart showing a comparison of his charges versus Porter and Nero:

I think the murder and manslaughter charges will be "not guilty," based on the (lack of) evidence presented at trial. Plus there is the ME that lied as to the manner of death. Even if it wasn't proven in trial testimony, the judge heard what the lead detective had to say.

I keep thinking about the Nero trial when the Judge said no matter what the decision is, one of the parties will appeal. If Goodson is found guilty of the "negligent assault" and/or "reckless endangerment" = appeal. BUT if he is acquitted on ALL charges, with the prosecution misconduct brought to light & Donta Allen's piss-poor testimony for the State, MAYBE this will force Mosby to drop charges on the remaining officers.

The only real charge I see as a possibility is "reckless endangerment" but you had the "rough ride" (Franklin) expert's befuddled testimony in that regard. So the "misconduct in office" charge is the last ONLY possibility.

With any luck (weight of evidence) Goodson will get acquitted in a few hours.. the rest of the farce will unravel.

Then Mosby et al are on track to suffer the consequences of malicious prosecution.l
