Judge orders Porter to testify at Goodson trial; Jury selection set for Monday

BALTIMORE —Circuit Court Judge Barry Williams denied a motion by Officer William Porter's attorney to squash a subpoena for him to appear at the trial of fellow Officer Caesar Goodson trial, the second of six Baltimore police officers to face trial in the death of Freddie Gray.

Williams said Porter will be compelled to testify. Porter's attorney, Gary Proctor, is expected to file an injunction with Court of Special Appeals to block the order to compel his testimony in Goodson's trial.

Porter was called to the stand prior to the ruling and invoked his Fifth Amendment rights against self-incrimination. Williams warned prosecutors if Porter testifies in the Goodson trial, it could impact their ability to retry him after Porter's case ended in a mistrial in December.

Should Porter testify, Williams said, the state has been placed on notice that they have an interesting burden to show they did not use the testimony in any shape or form.

Proctor said "once the cat is out of bag, you can't put it back" when it comes to Porter's testimony.

Williams said Porter's Fifth Amendment rights would not be violated in his retrial if granted immunity in Goodson's trial. Williams said this decision is uncharted territory as witnesses granted immunity usually have pleaded to lesser charges or had charges dropped.

Two Trials Rescheduled

The link does not mention delay in Goodson trial?

But I assume there will be a delay? Maybe not? Jury selection due to start Monday, 11th January.

It is ridiculous foe State to argue that Porter must testify (and harm his own legal position) BECAUSE his not testifying will damage State's case against other people.. absolutely absurd to propose that an individuals own legal rights are secondary to the State's desire to convict a third party.

If the State is arguing that Porter HAS to testify because not doing so stuffs up their case against 3 others then that seems ludicrous to me. To propose (with a straight face) that an individual (Porter) must have his legal rights subverted for the greater good.
Sure sounds like moonbat liberal notions to me

Williams should be thrown off the bench and Mosby should be thrown off the bar.

I'm listening to Trump so I only have a brain engaged here but if the State is saying they have no case without Porter it about the millionth time they have shot themselves in the foot.

Appeals court halts trial for 2nd officer charged in Freddie Gray's death

The Maryland Court of Special Appeals issued a stay Monday that halts the trial of Caesar Goodson Jr., the second of six Baltimore police officers charged in connection with the death of Freddie Gray.

The stay concerns the question of whether another of the charged officers, William Porter, can be compelled to testify in Goodson's trial.

Jury selection in Goodson's trial was slated to begin Monday, but the stay brings the proceedings to a stop until the issue of Porter's testimony is resolved.

The order leaves open the possibility for prosecutors to file a motion to remove the stay.

Wow! this is almost saying without Porter they have no case.


The facts are the DA has no case. I can't believe her husband is running for mayor. Which of course is likely the plan all along, which is why Mosby directly demanded that police officer's clean up her husband's district which is likely why Freddie Grey was pursued and ended up smashing himself around to the point of death.

The motion was also signed by Deputy State's Attorney Janice Bledsoe and Assistant State's Attorney Matthew Pillion. Attorneys in this case are barred from commenting on any ruling due to a gag order imposed by the judge.

The Mosby motion (ruled as Moot by Judge Williams) is clearly grasping at straws. An about face, begging the Judge to NOW grant a retrial for Porter before Goodson and White.
Even IF that happened and IF Porter found was guilty, it still DOES NOT fix Mosby’s problem. Porter would still need to invoke his 5th amendment rights while appeals pending. And even if aquitted, Porter faces the (now standard for a black “victim”) threat of Federal investigation and charges.
