It "worries me" when Juries take more than a few hours.. on any trial.

They ARE supposed to be following the evidence closely as it is happening.. being presented in court... they should not NEED to go back over most of it.... obviously the odd thing to see up close and review... but if they haven't followed the case as it was presented in court.. then their own "deliberations" are fraught with danger.
As I have said before.. I am NOT impressed with what constitutes the "average" as far as citizens go... it seems to be a very LOW standard.. low on intelligence, logic and comprehension. I have suggested before that we need a pool of "professional Jurors".. selected for some level of smarts.. and ability to draw logical inferences from info. Trained and instructed in at least basic principles of law and justice... maybe reserves type thing as with Army.. people with regular jobs.. called up when needed to serve in Jury Pool for a period. paid generously so that service is not a financial strain.

After the one juror was replaced by an alternate it is actually seven blacks and five whites and according to a tweet by a reporter we won't find out the split.

Court spokeswoman told me that if jury is hung on any of the counts, we won't know how they split. Court won't release that information.

OMG, there are so many uneducated, misinformed people with a twitter account -- tweeting nonsense. You can tell they have never followed a trial in their lives, but they are suddenly legal experts because someone else tweeted it. :doh

Jury tells Judge Williams they cannot arrive at a verdict; Judge sends them back to try again

UPDATE (4:01PM, 12/15/15): In a shocking statement, trial Judge William Barry told the hung jury to “Compromise if you can do so without violence to your own moral judgement,” according to reporting by ABC News.

Such a statement coming from a trial judge is shocking because “compromise verdicts” in criminal cases are anathema to American concepts of jurisprudence and due process.

Each juror is sworn to vote for a guilty verdict on a charge only if they honestly believe that each and every element of that charge has been proven beyond a reasonable doubt.

If they do not so honestly believe this to be the case for a given charge, they are sworn to vote not guilty on that charge. Period.

This lies at the core of the legal mandate that the defendant has the presumption of innocence.

There is no proper room for compromise in such a judicial framework.

While it is true that criminal trial jurors do from time to time arrive at so-called compromise verdicts, such instances are considered defects in the judicial system, not legitimate outcomes.

If ever there were grounds for reversal of any conviction, this is it.

Jury began deliberating around 8:35AM today. No notes or communication with jury after 2 hours.
Possibilities today?

I have predicted from the beginning that this is going to be a mistrial. Either that or an acquittal. Now the mistrial seems most likely.

And the judge gave this instruction to the jurors when they said they were deadlocked.

In my opinion there can be only one interpretation of this statement, the judge is putting pressure on the jurors to convict on the lesser charge(s). Compromise means a meeting of minds, if there is a “guilty as hell side” (I’m sure that there is) and there is a “this is a witch hunt side” (and I’m sure that there is) then the only compromise there can be, is a guilty verdict on one of the lesser charges.

Someone said Porter had a lousy attorney, perhaps they are correct.


In a lawful America this judge would be thrown off of the bench.

I was taught that the number one reason why criminal convictions are reversed on appeal are due to mistakes in instructions to juries. What Judge Barry Williams tells the jury before they deliberate this week in State v. William Porter, the first of the Freddie Gray trials, is therefore crucial to a just result.

One thing State's Attorney Marilyn Mosby has successfully (and wrongfully) done is create in the public mind the idea that failing to use a seat belt is a criminal offense. She mentioned the police failure to seat belt Gray over and over again in her speech announcing criminal charges. Michael Schatzow and Janice Bledsoe, the trial prosecutors, have harped on it repeatedly with every witness.

But it's not a crime. In fact, in Maryland the failure of persons injured in an auto accident to use seat belts isn't even negligence on their part. Yet Mosby uses lack of a seat belt as the crux of her criminal case, and so do people who want the police department to be held "accountable" for Gray's death, not accepting the fact that accountability came through a civil settlement.

Fox is reporting a Freddie Gray verdict but then nothing more. Also a "verdict" could mean hopelessly deadlocked.
