As Porter Trial Heads To Jury, Attorneys Attack Competing Witness Tales
Sunday, December 13, 2015
Robert Lang and Tyler Waldman, WBAL NewsRadio 1090

The trial of Officer William Porter will head to the jury by the end of the day.

Porter is the first of six Baltimore City police officers to stand trial for the April 19 death of Freddie Gray, who died one week after suffering a broken neck and spinal cord injury after he was arrested and loaded into a police van and taken to the Western District police station. Exactly two weeks after jury selection began, the jury of seven women and five men will retire to the jury deliberation room, likely this afternoon, to decide whether Porter is guilty of any of the four charges against him.

Those charges are involuntary manslaughter, second degree assault, reckless endangerment and misconduct in office.

Before that happens, the jury will hear closing arguments. Assistant State's Attorney Janice Bledsoe delivered the prosecution's closing argument. She began by demonstrating how long it would take to buckle a seatbelt then spent much of her closing discussing the inconsistencies between what Porter told an internal affairs detective in a videotaped interview and what he said in his own testimony, when he took the stand in his own defense. She said internal affairs Det. Syreeta Teel, who testified, took meticulous notes on what Porter said in his interview, and echoed a state's witness when she called prisoner safety "a shared responsibility."

"The van became Freddie Gray's casket on wheels," Bledsoe said, adding that the officer "had an opportunity on four occasions to save Freddie Gray and didn't."

Defense attorney Joseph Murtha said all the prosecution witnesses said something that should cast doubt on the state's theory, and reserved his sharpest criticism for assistant medical examiner Carol Allan, who performed Gray's autopsy and said that her finding of homicide was based on what he characterized as merely theories.

"That alone should raise doubts in the jury," Murtha said.

Judge says they may deliberate beyond closing time (5pm) but only if they do so unanimously.

Jury Question 4:22PM

Ron Snyder@SnyderWBALTV
UPDATE: #PorterTrial jury asked for 12 copies of the 4/12 radio transmissions and of Porter's 4/17 statement to police.

The #PorterTrial jury was allowed to read the transcripts during trial as they were played in court.

But Judge Barry Williams denied the request during deliberations as the transcripts were not entered into evidence in #PorterTrial

The #PorterTrial will have the ability to rewatch the video of the statement to @BaltimorePolice and listen to the radio transmissions

#PorterTrial jury asked if they could end jury deliberations at 530pm. Judge Williams said he would grant that request.

#PorterTrial jury asked for definitions of evil motive, bad faith and not honestly. Terms jury asked about were specific to the misconduct in office charge

UPDATE: Judge Williams denied #PorterTrial jury request on definitions it requested.

Judge Williams response to #PorterTrial jury: "The court has provided all the information to you that it can."

Jury is dismissed for the day.

Jury will resume deliberations tomorrow morning at 8:30AM.

It was jury's request to start early.
And they requested candy, which the Judge said he will provide.

YES, lol. :)

He remembers the YT vid of the woman talking about the shame in Baltimore after the rioting. There was a slide show of the looters, and she kept asking "what's up with all the toilet paper?".

Verdict Watch - Day 2

Ron Snyder@SnyderWBALTV
Jury began deliberating at 8:30AM, lunch scheduled for 12:30-1:30 (if necessary) and quitting time is 5:30PM.

Three notes from jury
1. More water. 2. More legal pads. 3. Can they have list of exhibits. Judge denies last one because it was not entered into evidence.

Defense asks to change venue, dismiss charges & questions jurors because of letter sent to Baltimore school parents yesterday.

Judge Williams said jurors have been clearly told only to consider info from court and letter not "an appropriate reason" for mistrial.

Ron Snyder@SnyderWBALTV
#PorterTrial jury asked for speakers for computer to better hear audio and video evidence.

Jury request for speakers granted. Jury deliberations continue. :44
