Judge refuses to sequester jury in Officer William Porter trial

BALTIMORE —A Baltimore judge ruled Tuesday that the jurors in the trial of Officer William Porter will not be sequestered, but jury members will remain anonymous.

Baltimore City Circuit Court Judge Barry Williams heard as many as 14 motions. On the jury motion, Williams said he was concerned that disclosure of the names could lead to harassment and expose the jury to unwanted publicity. Jurors will be able to go home each day.

The judge again denied a defense motion for change of venue. The defense offered two items to support their argument for a change of venue: A newspaper article and a study on how city residents view police.

Williams sternly denied the request again.

"Denied. Sit down," Williams told the defense. "You may be seated."

Both the defense and prosecution will get four opportunities to dismiss a potential juror. The defense wanted as many as 10. The judge abruptly stopped a defense argument saying, "I'm satisfied that I am right and you are wrong. The (Maryland) Court of Appeals will tell me I'm wrong."

The judge also denied the prosecution's motion to limit the number of character witnesses the defense can call to testify, giving the defense a chance to call 25 witnesses on Porter's behalf.

Porter is prepared to testify on his own behalf when his trial begins on Nov. 30. He waived his right to appear at a pretrial hearing. Jury selection begins Monday. The judge said he wants to call up 75-80 people at a time.

Trial begins for first of six officers charged in death of Freddie Gray

On Monday, jury selection began in the trial of Officer William Porter, 26. Porter, who is black, is charged with manslaughter, assault and reckless endangerment. He has pleaded not guilty.

The pool of potential jurors includes about 75 people, some 40 of whom are African American. The others are white, with the exception of one Latino and one East Indian.

All of them told Judge Barry Williams they knew about Gray’s death and about a financial settlement the city had reached with his family.

Inside the courtroom, the chants of protesters outside could be heard clearly: “All night, all day, we’re going to fight for Freddie Gray.”

Following preliminary questions, potential jurors were to be individually questioned in a conference room out of view of reporters. About half of the potential jurors said they had been either the victim of a crime, investigated by law enforcement, convicted, incarcerated or were under pending criminal charges.

Williams said opening statements and testimony would begin in the next few days and that the trial in Baltimore City Circuit Court would be over by December 17.

Baltimore Police Officer William G. Porter told police investigators in a taped interview played for jurors Friday that he didn't believe Freddie Gray was truly injured as the 25-year-old asked for medical attention in the back of a police van.

Porter, speaking to detectives in April as Gray lay in a hospital bed, said he knew Gray from prior interactions and that he had a reputation for being difficult during arrests. He said Gray seemed lethargic inside the van, but responded to questions and did not articulate a specific medical problem.

"I said, 'What's your deal, what's wrong with you. ... He doesn't say anything, just 'help,'" Porter told the investigators.

Judge Barry Williams declined Monday to declare a mistrial, as the defense requested, but ruled that the prosecution had committed a discovery violation and that the information could be introduced by Officer William G. Porter's defense, as the trial entered its second week.

    Dr. Carol Allan and a second medical expert for the prosecution — Dr. Morris Marc Soriano, an Illinois neurosurgeon — both testified that Gray's life could have been saved had Porter called for a medic when Gray first told him he needed one.

    Joseph Murtha, Porter's attorney, asked Soriano whether Porter would have been able to tell that Gray was in intense pain. "Not necessarily," Soriano said.

    Murtha also asked Soriano if he could testify that Porter had "extensive knowledge" of Gray's injuries. Soriano said he could not.

    Raising the idea of a "pre-existing condition," Murtha asked the experts whether their testimony would change if they knew Gray had suffered a previous back injury.

    Soriano said his testimony likely would not change unless the injury was specific to Gray's cervical column. Allan said she had not noticed any evidence of a previous back injury during her autopsy of Gray.

Prosecutors rest their case against Officer Porter, judge rules trial will continue

Judge Barry G. Williams ruled the case against Officer William G. Porter in the death of Freddie Gray will continue, after turning back a request from the defense to dismiss the charges.

The defense request came after the state rested its case Tuesday morning, after calling about 15 witnesses over the course of less than five days. Jurors were sent home for the day, and the defense's presentation will begin Wednesday morning.

Gary Proctor, one of Porter's defense attorneys, said prosecutors had not proved that Porter's failure to seatbelt or seek immediate medical attention for Gray rose to a "gross, wanton, deliberate" act necessary to prove involuntary manslaughter.

"There was no testimony that what Officer Porter did was any sort of deviation from what a reasonable officer would do," Proctor said, referencing an element needed to prove a crime was committed.

Chief Deputy State's Attorney Michael Schatzow said Porter showed a "callous indifference for life" when he deviated from department policies. Defense attorneys have said other police officers routinely break such policies, but Schatzow said those officers should not be considered "reasonable."

"A reasonable officer follows orders and directives," Schatzow said.

Williams said there was sufficient evidence presented for the case to put to a jury.

  • Schatzow told the jurors that Porter ignored several chances to help Gray, being involved at five of six stops the transport van made on its way to Central Booking.
  • Schatzow emphasized that Gray was not seriously injured at that time, saying video shows him lifting his head as he is on the ground handcuffed, and bearing weight as he climbed into the van.
Defense opening statements
  • Defense attorney Gary Proctor said his client was suspicious of Gray showing "jailitis," or feigning injury to avoid going to jail.
  • Porter saw no obvious reasons to request a medic for Gray, Proctor said. Porter checked on Freddie Gray because he was concerned but saw no outward signs of injury that would have required calling a medic.
  • Porter knew Gray from previous interactions, including an incident a few weeks before Gray's arrest in which he had been taken into custody and attempted to kick the windows out of a squad car.
  • Proctor painted the Baltimore Police Department as a poorly trained, supervised and staffed agency where rules were advisory but routinely not followed.
  • Let's show Baltimore the whole damn system is not guilty as hell- Defense attorney Gary Proctor told jurors, an allusion to a line often shouted by protesters of police misconduct
  • Proctor said Porter was a good cop with no record of misconduct, who was born and raised in West Baltimore, wanted to help his community and showed discretion on the streets.

BALTIMORE - Officer William Porter took the stand in his own defense Wednesday, saying Freddie Gray gave no reason to call for a medic.

Porter is the first of six Baltimore police officers to stand trial in Gray's death.

He is currently testifying. Follow updates from court here.

Asked why he didn't call a medic, Porter said it was because Gray did not give him a reason to do so and he didn't see anything externally wrong with him.

Porter said Gray did not tell him that he couldn't breathe. He said he heard Gray say that only during his initial arrest.

Porter testified that he did not see Gray being loaded into the police transport van. He said it's the responsibility of the officer in the transport van to get from point A to point B.

Officer Porter Claims He Was Unaware Of New Seat Belt Policy, Gray Never Asked For Ambulance


Officer William Porter has participated in more than 150 arrests in his time as a Baltimore police officer. Not one was seat belted in a police transport.

That admission came in testimony from Porter himself, who took the stand in his own defense Wednesday as the second witness his attorneys called to the stand.

Porter is one of six Baltimore City Police officers charged in the April death of Freddie Gray, who died April 19, one week after suffering injuries in a police transport van following his arrest. Gray's death sparked a week of protests, riots, looting and a state of emergency in Baltimore City.

While a new mandatory seat belt policy was emailed to officers three days before Gray's fateful arrest, according to testimony from former police Commissioner Anthony Batts' chief of staff, Porter said he didn't have an app on his department-issued phone to allow him to check his email and would have had to come in early or stay late to read it. The policy was included in what was an 80 page email.

He said her spoke to Brandon Ross, who caught Gray's arrest on video, at the scene and told him to go to the media with it.
