Keep in mind:
  • No wrongdoing has ever been found
  • Marilyn Mosby’s private attorney is the same attorney as Freddie Gray’s family
  • The Gray family never filed a lawsuit, so this is not a “settlement” per se
  • The possibility of any police wrongful conduct being found during trial is quite probably nil
  • The maximum payout under Maryland state law, if lawsuit filed – and if police misconduct could be identified, would have been $400k.

UPDATE: The nine-page agreement, obtained Wednesday by The Baltimore Sun, shows that Gray’s mother, Gloria Darden, will receive $5.36 million. Gray’s father, Freddie Gray Sr., will receive $640,000. The remainder, $400,000, will be paid to the “Estate of Freddie Gray Jr.”

The city agrees to pay $1.8 million within 15 days, to be divided proportionately among the parities, according to the document. Another $1 million must be paid by Nov. 1.

The remaining $3.6 million will be paid out in the next fiscal year.

Change-of-venue motion denied in Freddie Gray trials
Protesters rejoice in decision

BALTIMORE - A judge Thursday morning denied a change-of-venue motion in the trials for six police officers charged in the death of Freddie Gray.

Defense attorneys for the officers said that many in the city consider the defendants "poster children" for anger over police in general.

Defense attorney Ivan Bates argued that pre-trial publicity, riots and the $6.4 million settlement approved Wednesday makes finding a fair jury impossible.

The defense said many jurors will feel an impact of potential juror intimidation and feel compelled to convict over fears of riots.

Activist Judge Barry Williams gave activist Prosecutor Marilyn Mosby a big assist in her goal to convict six Baltimore police officers. Williams ruled against a venue change motion while saying there’s no evidence they will be unable to seat an impartial jury.

The pre-trial hearings continue this afternoon.

A Baltimore Circuit Court judge ruled Thursday morning that the trials of six police officers charged in the arrest and death of Freddie Gray will stay in Baltimore, saying the defense had failed to prove that the officers cannot receive a fair trial in the city.

“The citizens of Baltimore are not monolithic,” Judge Barry Williams said in his ruling. “They think for themselves.”

Yes Alice, DeRay McKesson is going to be teaching at Yale, and now Jamal Bryant announces he’s running for congress. Bryant will be targeting the congressional seat currently occupied by Elijah Cummings, as Cummings is widely expected to run for the Senate.

Many people will remember Jamal Bryant from his involvement with the Freddie Gray protesting community. However, some might remember Bryant from his involvement with the fraudulent narrative surrounding Trayvon Martin fiasco.

A Baltimore City high school student has been charged with attempted murder as an adult after a shocking video surfaced online showing him savagely beating a classmate in the school cafeteria.

The fight broke out between the two males at Frederick Douglass High School at lunch on Wednesday and video of the brawl was uploaded toFacebook.

The aggressor can be seen in the confronting 30-second footage repeatedly punching the other student in the face before brutally stomping on his head.

The cell phone video of the attack finishes with the victim lying on the floor bleeding and having a seizure.

Baltimore officer said Freddie Gray asked for help

As Freddie Gray was being transported in a police van through West Baltimore, at least one officer warned that Gray needed medical care but wondered, along with others, whether he was faking injuries or being uncooperative, according to investigators who reviewed the officers' statements during a departmental probe.

Those statements — which have never been publicly revealed — help to explain why a judge has ordered separate trials for six officers charged in the incident. Some of the statements provide differing accounts of events that day; defense attorneys have argued in court that such conflicts could create problems in a joint trial.

Officer William Porter told police investigators that after being summoned to check on Gray on the morning of April 12, he told the van's driver that the city booking facility would not process Gray because he was in medical distress.

"Help me. Help me up," Gray said.

Porter helped Gray up and asked, "Do you need a medic or something? Do you need to go to the hospital?"

When Gray responded affirmatively, Porter said he told the van's driver, Officer Caesar Goodson, Jr., that Central Booking wouldn't accept Gray. Porter also told investigators he wasn't sure if Gray was in distress, or trying to convince officers to take him to the hospital instead of jail.

Baltimore Judge To Schedule First Trial In Freddie Gray Case

BALTIMORE (WJZ)– Another important court hearing is scheduled Tuesday afternoon in the Freddi Gray case.

Derek Valcourt explains this hearing is expected to be all about scheduling the trials for the six officers charged in Freddie Gray’s death.

The first of the trails is scheduled to start in about two weeks, but lawyers expect to make the case they’ll need more time to properly prepare a defense.

A judge ruled all six officers accuse in the April death of the Gray will each get their own trials.
Prosecutors have said they want to put Officer William Porter on trial first since statements he made to investigators make him a critical witness in the case against some of the other officers.

According to WJZ media partner, The Baltimore Sun, Porter reportedly told investigators that Gray asked for medical attention before his death, but he wondered if the 25-year-old man was faking his injuries.

(CNN) Trial dates were set Tuesday for the six Baltimore police officers charged in the death of Freddie Gray. The first trial, that of Officer William Porter, is scheduled to start on November 30; the last officer's trial in March.

• Goodson is charged with one count of second-degree depraved-heart murder, involuntary manslaughter, second-degree assault, manslaughter by vehicle (gross negligence), manslaughter by vehicle (criminal negligence), misconduct in office and reckless endangerment. His trial is set to start January 6.

• Porter is charged with one count of involuntary manslaughter, second-degree assault, misconduct in office and reckless endangerment.

• Officer Garrett Miller is charged with one count of second-degree assault, two counts of misconduct in office and one count of reckless endangerment. His trial is set to start February 9.

• Officer Edward Nero is charged with one count of second-degree assault, two counts of misconduct in office and one count of reckless endangerment. His trial is set to start February 22.

• Lt. Brian Rice is charged with one count of involuntary manslaughter, one count of second-degree assault, two counts of misconduct in office and one count of reckless endangerment. His trial is set to start March 9.

• Sgt. Alicia White is charged with one count of involuntary manslaughter, second-degree assault, misconduct in office and reckless endangerment. Her trial is set to start January 25.

The order of the trials, which Judge Williams has ruled will be held separately, is important because, for one, Porter is expected to implicate other officers.

After the judge pushed Porter's trial back to November, the defense for the other five officers asked to have those trials moved up. The judge denied that request and scheduled their clients consistently after Porter's trial.

Defense points to new Freddie Gray evidence in calling for sanctions against prosecutors

Prosecutors have turned over new evidence in the Freddie Gray case that defense attorneys say should have been handed over months ago, including witness statements that Gray was "losing his mind" and kicking and shaking the police transport van where he sustained a fatal spinal cord injury.

Attorneys for the six Baltimore police officers charged in Gray's arrest and death asked that the court sanction prosecutors, repeating a request made in July. The defense wants prosecutors to hand over additional evidence and the court to exclude from trial any evidence withheld from them.

Prosecutors allege the officers failed to secure Gray in a seat belt in the van and to provide timely medical attention. Gray, 25, was arrested and injured April 12, and died a week later.

The latest evidence, provided to the defense in recent weeks, could be key to the defense, the officers' attorneys said. They argued that Gray's erratic behavior in the van not only indicates it may have been reasonable under the circumstances to not place him in a seat belt but also that Gray may have caused his own injuries.

The defense said that, given the nature of the evidence the prosecution has already withheld, the court should reconsider its earlier motion to compel the state to release evidence and sanction the prosecutors.

Man charged in CVS arson faces 4 years in prison under plea deal

A 24-year-old man accused of setting a CVS store in West Baltimore ablaze — one of the indelible images of the city's April unrest — could receive a sentence of four years in prison after he pleaded guilty Wednesday to committing arson during the act of rioting.

The charge to which Raymon Carter pleaded could cut a year from his prison sentence. Carter was initially charged with arson, which carries a mandatory minimum five-year prison sentence. The rioting charge allows a lesser punishment because Carter agreed to plead guilty.

The deal requires Carter to pay for some of the $1.1 million in damage to the pharmacy. Prosecutors said that agreeing on an amount will be tricky because looters also contributed to the losses and Carter does not hold significant assets.

"The most important aspects of this case are that Raymon Carter will be punished for participating in the riot and that ordinary citizens concerned about their neighborhood helped to catch him," U.S. Attorney Rod J. Rosenstein said in a statement. "Anyone who considers participating in a riot should know that police, prosecutors and citizens will track them down and send them to prison."

Carter's only statements to U.S. District Judge Ellen Hollander at a hearing in Baltimore federal court were "Yes, ma'am" and "No, ma'am" as he waived his right to a jury trial and confirmed that he understood the plea agreement.

Carter is scheduled to be sentenced Nov. 17. If a judge rejects the plea deal, Carter may rescind his guilty plea.

The deal reserves Carter's right to appeal the amount of restitution he is required to pay.
