Activists planning protests around Freddie Gray hearings, as police prepare

Activists plan to protest at the courthouse and elsewhere in the city as hearings begin Wednesday in the case against six Baltimore police officers charged in Freddie Gray's arrest and death.

Prosecutors and defense attorneys are set to argue whether Judge Barry Williams should dismiss the case or recuse Baltimore State's Attorney Marilyn J. Mosby. They also will discuss whether the six officers — who have pleaded not guilty — will be tried separately or together.

The attorneys are then set to argue whether to move the case out of Baltimore at a second hearing scheduled for Sept. 10.

"Our message is pretty obvious. Do not drop the charges. No change in venue. Do not recuse Marilyn Mosby," said Sharon Black of the Baltimore People's Power Assembly, an organization known for its protests against alleged police brutality. It is planning the demonstration at the downtown Circuit Court.

"Our demands are pretty simple. We want to keep the attention on those three issues."

Police and city officials have been preparing for protests — and possible unrest — in light of the hearings. The Police Department canceled leave to maximize availability of city officers for both hearings, a police spokesman said on Monday.

The Baltimore Sheriff's Office, which is responsible for safety at the Calvert Street courthouse, also said it will have "an increased presence" in and around the courthouse.

Understanding Freddie Gray pre-trial hearing

BALTIMORE - Two days have been set aside for each side in the Freddie Gray case to argue pretrial motions in front of Judge Barry Williams.

It could take at least that long to wade through a case file that has grown past three full accordion folders of points and counterpoints.

At issue will be some pretty contentious topics including motions to dismiss charges, whether or not Baltimore City State’s Attorney Marilyn Mosby's office should be disqualified from trying the case, if all six officers should be tried together and eventually a change of venue.

"I am not sure there is going to be any finality for these cases tomorrow," Jeremy Eldridge said.

Eldridge is a current defense attorney with Eldridge and Nachtman but was formally an assistant state's attorney.

Wednesday he says is simply part of the legal process, motions that may determine some ground rules for the trial.

The big motion tomorrow will be the defense's belief that Marilyn Mosby and her office has a conflict of interest in the case and that the charges against the Baltimore six should be dismissed.

(Via Baltimore Sun) After months of sharply worded motions by prosecutors and defense attorneys, legal questions surrounding the officers charged in Freddie Gray‘s arrest and death will be aired publicly for the first time in a solemn, wood-paneled courtroom in downtown Baltimore.

What is going to happen Wednesday? Prosecutors and the defense attorneys representing the six Baltimore Police officers charged in the arrest and death of Freddie Gray are scheduled to appear in court for a hearing in which the judge will hear arguments on key motions in the case.

One is a defense motion to dismiss the charges against the officers because of prosecutorial misconduct by Baltimore State’s Attorney Marilyn Mosby; the second is a motion for Mosby and other prosecutors in her office to be recused from the case.

Both sides are also expected to debate whether the officers should be tried together or separately.

The pre-trial motions hearing is scheduled for 9:30 a.m. at the Circuit Court for Baltimore City, Courthouse East, 111 N. Calvert

Judge Barry Glenn Williams

Barry Glenn Williams has been an Associate Judge with the Baltimore City Circuit Court since December 2005. On Wednesday, he'll become a bit more of a household name.

Judge Williams will preside over Wednesday's hearings in the Freddie Gray case. He's anticipated to hear motions to dismiss the case for prosecutorial misconduct, recuse Baltimore State's Attorney Marilyn Mosby and other prosecutors, and determine whether six Baltimore police officers charged in Gray's death will be tried together or individually.

Next week, the hearings will include a motion to move the officers' trials out of Baltimore. That takes place on Sept. 10.

Charges stand against officers in Freddie Gray case

BALTIMORE - A Baltimore judge has refused to dismiss charges against six police officers accused in the death of Freddie Gray, a black man who died a week after suffering a critical spinal injury while in custody.

During a pretrial hearing Wednesday, Circuit Court Judge Barry Williams denied a defense motion for the charges to be dropped. Defense attorneys had sought to drop the charges because of prosecutorial misconduct on the part of State's Attorney Marilyn Mosby.

Williams said that while he was "troubled" by some of the comments Mosby made during a May 1 news conference, they did not compromise the defendants' right to a fair trial. He said allegations of prosecutorial misconduct must be addressed by the Attorney Grievance Commission.

The judge also denied a motion to recuse Mosby and her staff due to what defense attorneys characterized as conflicts of interest.

Baltimore Police Commander’s Son Charged With Murder in Death of Roommate

Melvin Russell, 28, the son of Baltimore Lt. Col. Melvin Russell, was arrested Tuesday in connection with the stabbing death of his roommate, the Baltimore Sun reports. His father heads the department's Community Collaboration Unit, which has been leading neighborhood outreach efforts, the news site notes.

According to the report, the younger Russell is facing charges of first- and second-degree murder, assault and weapons violations. The 28-year-old and his 49-year-old roommate reportedly got into a fight in which both sustained stab wounds. The roommate, who has not been identified, was pronounced dead at a hospital.

Baltimore City State's Attorney Marilyn Mosby has referred the case to county prosecutors, citing conflict of interest, the Sun notes.

10-Year-Old Latest Victim Of Bloody Summer For Baltimore Children

BALTIMORE (WJZ) — Baltimore police are looking for leads after multiple shootings in a West Baltimore neighborhood leave three people injured, including a ten-year-old boy.

The 10-year-old was apparently caught in the crossfire of a gun battle. He is the latest victim in what has been a bloody summer for Baltimore kids.

Baltimore police are going door to door, passing out fliers and pleading for information in Thursday night’s shooting along W. North Avenue.

At least a dozen shots were fired. Bullets struck two men and a 10-year-old boy playing nearby.

That frustration is being echoed by many near Thursday night’s crime scene.

“Us killing us equals genocide. So it’s time for us to pull together and to get the community together and help one another out,” said Lorenzo Davison.

The ten-year-old boy has already been released from the hospital. The other two victims are expected to survive as well.

Baltimore State's Attorney discounts connection between unrest and homicide surge

Baltimore State's Attorney Marilyn Mosby discounted a connection between this summer's surge in murders and the unrest following the death of Freddie Gray, saying she believes it is a "cyclical" uptick connected to the city's old zero-tolerance policies.

Mosby, appearing on WMAR-TV/ABC2's "Square Off" program, was responding to Maryland Shock Trauma Physician-in-Chief Dr. Thomas Scalea, who said the crime spike "seems temporally related to the riots." The discussion will air at 11 a.m. Sunday.

"I tend to disagree," Mosby interjected. "I think the violence was already going up. When you look at January, it was already like 28 murders. How many snow days did we have in January?"

Mosby said that so-called "zero tolerance" policies, implemented during the tenure of former Mayor Martin O'Malley, had eroded trust of law enforcement in many Baltimore neighborhoods and was fueling this year's spike by making resident less inclined to help police solve crimes.

This year, Baltimore had recorded 65 homicides in 109 days as of April 25 — the first day of disturbances following Gray's death. By that same date, the city had seen 54 homicides in 2014, 66 in 2013, 59 in 2012, and 65 in 2011, data show.

The number of killings has exploded since then, with 158 people killed in 130 days from April 25 through the end of August, including 45 homicides in July alone.

Organizers for Black Lives Matter Charleston have extended an invitation to Gov. Nikki Haley to have an open discussion on the group's methods and goals for reform. The request comes after the governor's recent address on race, during which she spoke out against the national Black Lives Matter movement, while also opening the door for a possible vice presidential run in 2016.

In a speech to the National Press Club in Washington, D.C., Wednesday, Haley focused on racial progress and the importance of open communication in South Carolina following the death of Walter Scott and the Mother Emanuel Church shooting.

Marilyn Mosby Blames Baltimore’s Exploding Violence on Martin O’Malley

In an interview with the City’s ABC affiliate, Baltimore State’s Attorney Marilyn Mosby insisted that there is no connection between the recent social unrest and riots and the city’s growing murder rate. Mosby also blamed Democratic Presidential candidate and former Baltimore Mayor Martin O’Malley for setting the stage for this year’s mounting violence.

During the taping of the local show “Square Off,” Maryland Shock Trauma physician-in-chief Dr. Thomas Scalea said the worsening violence in the city “seems temporally related to the riots.”

But Mosby completely disagreed with that assessment. “I think the violence was already going up. When you look at January, it was already like 28 murders,” she said.

Baltimore to pay Freddie Gray's family $6.4 million to settle civil claims

The Rawlings-Blake administration plans to pay Freddie Gray's family $6.4 million as a settlement for civil claims in his arrest and death — an extraordinary payment in a lawsuit against city police.

The settlement — which is expected to be approved at Wednesday's meeting of the city's spending panel — will be paid out over two years, according to the mayor's office. The five-member board is controlled by Mayor Stephanie Rawlings-Blake.

The payment is larger than the total of more than 120 other lawsuits brought against the police department for alleged brutality and misconduct since 2011.

Gray, 25, died in April after sustaining a severe spinal cord injury in police custody. In the hours after his funeral, the city erupted into rioting, arson and looting. The National Guard was called in to help restore order, and a citywide curfew was put in place.

Six officers who were part of Gray's arrest and transport in a police van have been charged with crimes ranging from murder to assault; all have pleaded not guilty. A pre-trial motions hearing is scheduled Thursday for a judge to decide whether to move the cases out of Baltimore; defense attorneys say the officers cannot get a fair trial here because of the intense publicity surrounding the case.

Billy Murphy, the lawyer representing Gray's family, declined to comment. A spokeswoman for Baltimore State's Attorney Marilyn J. Mosby also had no comment.

For fuck sake.. what is WRONG with people.

I would CHARGE Freddie gray's family for the van ride!! At the very least I would wait until the outcome of the trial is known

On the face of things, Freddie Gray may have intentionally damaged himself and caused his own death. At worst this is an accident. I don't see no 6.5 Million liability for it?
