Beats me.
If he is indicted it sets a precedent, makes "rules of engagement" untenable for cops.
It would pay to make areas "no go zones" that cops stay out of. Let the War lords and Silver-back apes run the place.

They may as well declare Ferguson a lawless zone if Wilson fired. As to Jackson if he is making the rules about allowing his men and women to be spat upon, threatened, have their vehicles damaged, and so on, he should be given the boot but I am sure that is not why his position is being called into question by TPTB.

Tweets yesterday said the activists walked out while others were speaking.

The Ferguson activists are in Geneva, Switzerland testifying before the UN Human Rights Council on torture and abuse in America.
Yes, really.

Today they stood with Black Power fists at the UN meetings in Geneva while US gvt delegation testified.

What's disputed about the shooting

The accounts of eyewitnesses and police differ. Here is what some of the eyewitnesses at the scene of the shooting said happened, as well as Wilson's reported account.

Dorian Johnson's account

This is what Johnson, a friend of Brown's who was with him when he died, said happened: He and Brown were walking in the middle of the street when Wilson intercepted them and told them to get on the sidewalk. When Wilson tried to get out of his car, the door hit Johnson and Brown and ricocheted into Wilson — upsetting the officer. Wilson grabbed Brown by the neck, and Brown tried to get away. Wilson pulled out his gun and shot Brown. At that point, Brown and Johnson began to run away and the officer fired again. When Brown realized he was hit, he turned around and raised his hands in the air. Wilson approached Brown and fired several more shots.

Tiffany Mitchell's account

This is what Mitchell, who saw the shooting while on her way to pick up an employee in the area of the shooting, said happened: She first saw a struggle between Brown and Wilson, with Brown trying to push away from the police car and Wilson trying to pull the teenager into the vehicle. The first gunshot then came from the car, while both of Brown's hands were outside the vehicle. At that point, Brown broke away and started running down the street. Wilson chased after Brown while shooting at the teenager. Brown's body jerked, as if he was hit, and he turned around, stood still, and put his hands up. Wilson continued shooting Brown even as the teenager attempted to surrender, and Brown went down.

Piaget Crenshaw's account

This is what Crenshaw, who saw the shooting while she was waiting for a ride to work, said happened: She saw Wilson try to pull Brown into the squad car. When Brown ran away with his back facing the officer, Wilson fired several shots. Brown then turned around and began putting his hands up, and Wilson fired more shots and Brown collapsed. Crenshaw recorded video after Brown was killed, which she turned over to police.

Anonymous local resident's account

This is what an anonymous local resident, who reportedly saw the shooting from start to finish, said happened: Wilson and Brown appeared to tussle at the officer's police SUV. A shot went off, and Brown ran, followed by Wilson. Wilson aimed his handgun while yelling, "Stop! Stop! Stop!" Brown stopped, mumbled something inaudible, and took a step toward Wilson. The officer again told Brown to stop, and he fired three shots. Brown then put his hands up, staggered, and Wilson fired more shots as Brown fell to the floor.

Darren Wilson's account

This is what Wilson said happened, according to St. Louis County Police Chief Jon Belmar and a New York Times interview with unnamed government officials briefed on the federal investigation: Brown physically assaulted Wilson prior to the shooting. Wilson attempted to get out of the car, but Brown pushed him back into the vehicle. Brown then physically assaulted Wilson and attempted to grab the officer's weapon. Two gun shots were fired in the car — one missed, while the other hit Brown's arm. Brown then ran away, and Wilson fired more gunshots and eventually killed Brown about 35 feet from the police car. Wilson was reportedly injured during the encounter, and one side of his face was left swollen.

Did Brown's alleged robbery influence Wilson's actions?

Ferguson Police claim Brown and Johnson stole some cigars in a convenience store robbery prior to the shooting. Police clarified, however, that Wilson wasn't aware of the robbery allegations at the time of the initial stop and instead stopped Brown for jaywalking. Ferguson Police Chief Tom Jackson later told the St. Louis Post-Dispatch that Wilson realized Brown could be the suspect of the robbery when he spotted potentially stolen cigars in Brown's hand in the middle of the stop.

Man O man, I just got home, sat down and was treated to this rational respondent to the mad press. Kudos to this guy sorry I don't know his name and I'm too tired to check, and the Texas school board that gave the green boot to a racist, foul mouthed, individual. Kudos! Never mind Alfred Ray is the name right on his name plate. A unanimous decision, perhaps America is waking up, if so, well done Ferguson.

FERGUSON • The Aug. 9 fatal shooting here that sparked three months of protests and calls for change from around the world happened in less than 90 seconds, interviews and an analysis of police and EMS records shows.

The records, obtained by the Post-Dispatch via Missouri’s Sunshine Law, provide the best timeline yet for the events surrounding the shooting of Michael Brown Jr., 18. Also released were police station surveillance videos that provide the most recent images of Ferguson Police Officer Darren Wilson, who has not been seen publicly since the shooting. Wilson left the police station for the hospital two hours after the shooting, accompanied by other officers and his union lawyer.

The Ferguson police officer who fatally shot Michael Brown will be “immediately” returned to active duty if he is not indicted, Chief Tom Jackson told Yahoo News on Friday.

Officer Darren Wilson has been on paid leave since the controversial shooting in early August.

He would come back to a “not yet determined assignment,” the chief writes in an email.

If the grand jury charges Wilson, Jackson said the officer would “most likely” be terminated “if it is a felony.”

Attorneys representing the officer did not immediately respond to an email seeking comment. Wilson, a Ferguson officer for three years, has not spoken publicly since the shooting. It is unknown if the 28-year-old Wilson wants to return to the force.

“I would be surprised if they put him back on the streets at least in the near future,” said Bob Gorsky, a Dallas criminal defense attorney who has represented Texas police officers for nearly 40 years.

Gorsky said the amount of backing Wilson gets from the Ferguson Police Department will likely play a big role in the officer's decision to return.

Note: Suspect SHOT several times, but doped up thug kept coming.

Those who question number of shots fired by cops should consider this.

Does the officer survive? I won't watch it if he dies. I made that mistake once, there was no warning with the video and I will forever be haunted by that officers screams.

Michael Brown case: Ferguson teen's parents and double standards

On October 24th, Benjamin Crump, an attorney for Michael Brown's family, told MSNBC that "All Michael Brown's family has asked from day one is equal justice for their son. The concept of due process, this notion of all the laws in the legal proceedings being fair for them, just like it is for a police officer."

I have to wonder how they define fair.

A grand jury has been reviewing evidence in the case against Officer Darren Wilson for the death of Michael Brown since August 20.
    Ms. McSpadden is being investigated for felony robbery in an incident
    involving her mother-in-law and the sale of "Justice for Mike Brown" merchandise.
    However, Ms McSpadden asked the police not to release the incident report.

This week, the grand jury heard from Dr Michael Baden, a forensic pathologist hired by the family's attorneys to perform an autopsy. This autopsy was done in addition to the one performed by the County Coroner, and another performed by a federal pathologist.

Attorney Crump has complained that when leaks happen he cannot have confidence in the grand jury, but another attorney for the family didn't hesitate to tell the St. Louis Post Dispatch that Baden is testifying.

It is unusual for an expert hired by one of the parties to address a grand jury. Typically the evidence presented is meant to be objective and the people who testify are meant to be not interested (or paid).

After hearing testimony for nearly three months in the death of Michael Brown, the 18-year-old unarmed African-American who was shot by Officer Darren Wilson on a Ferguson, Mo., street on Aug. 9, a St. Louis County grand jury is nearing a decision on whether to bring criminal charges.

Routinely, grand juries are virtual rubber stamps for prosecutors, approving the proposed indictments after hearing from a few witnesses and getting the bare outlines of the incriminating evidence.

But the Ferguson case, laden with incendiary emotions, is anything but routine, and the grand jury proceeding has been highly unusual.

Monday Musings:

It's frigid as hell in St Louis this week, would be an opportune time to announce the GJ results, but I'm still guessing it will be at Thanksgiving time, when everyone's bloated with turkey and other sleep inducing fixings. Also the GJ meets only a few days a week, and they might have a witness or two left to hear, so another week before announcement seems possible. Time will tell.

And I'm not going to be surprised if they come back with a true-bill to indict, for the lesser charge of unnecessary use of force. All the media leaks that Wilson won't be charged with anything are based on subjective opinions, probably filtered by prosecutors and/or law enforcement who would want to diffuse the outrage and shock element of a no-bill outcome coming without warning. The jury hasn't deliberated yet to decide on charges or not. And it's a mistake for jury-watchers to make assumptions about what they are going to do from their demeanor, or by questions asked during testimony. And they're not charged to decide guilt or innocence -- only if there's enough evidence to charge a defendant with a crime. And GJ's do charge defendants around 90% of the time.

Of course, based on the evidence we've seen, no charges should be filed, but the 'charging a ham sandwich' element is always in play in grand jury decisions.

WHEREAS, regardless of the outcomes of the federal and state criminal investigations, there is the possibility of expanded unrest; and

WHEREAS, the State of Missouri will be prepared to appropriately respond to any reaction to these announcements; and

WHEREAS, our citizens have the right to peacefully assemble and protest and the State of Missouri is committed to protecting those rights; and

WHEREAS, our citizens and businesses must be protected from violence and damage; and

WHEREAS, an invocation of the provisions of Sections 44.010 through 44.130, RSMo, is appropriate to ensure the safety and welfare of our citizens.

NOW, THEREFORE, I, JEREMIAH W. (JAY) NIXON, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and Laws of the State of Missouri, including Sections 44.010 through 44.130, RSMo, do hereby declare a State of Emergency exists in the State of Missouri.

I further direct the Missouri State Highway Patrol together with the St. Louis County Police Department and the St. Louis Metropolitan Police Department to operate as a Unified Command to protect civil rights and ensure public safety in the City of Ferguson and the St. Louis region.

I further order that the St. Louis County Police Department shall have command and operational control over security in the City of Ferguson relating to areas of protests, acts of civil disobedience and conduct otherwise arising from such activities.

I further order that the Unified Command may exercise operational authority in such other jurisdictions it deems necessary to protect civil rights and ensure public safety and that other law enforcement agencies shall assist the Unified Command when so requested and shall cooperate with operational directives of the Unified Command.

I further order, pursuant to Section 41.480, RSMo, the Adjutant General of the State of Missouri, or his designee, to forthwith call and order into active service such portions of the organized militia as he deems necessary to protect life and property and assist civilian authorities and it is further directed that the Adjutant General or his designee, and through him, the commanding officer of any unit or other organization of such organized militia so called into active service take such action and employ such equipment as may be necessary to carry out requests processed through the Missouri State Highway Patrol and ordered by the Governor of the state to protect life and property and support civilian authorities.

This Order shall expire in thirty days unless extended in whole or in part by subsequent Executive Order.

IN WITNESS WHEREOF, I have hereunto set my hand and caused to be affixed the Great Seal of the State of Missouri, in the City of Jefferson, on this 17th day of November, 2014.

ST. LOUIS — Following weeks of intense negotiations, the three largest police departments in St. Louis, Mo., have agreed on a dozen rules or policies they will follow as they engage with protesters after a grand jury announces its decision regarding Ferguson Officer Darren Wilson.

The negotiations have centered on 19 "Rules of Engagement" proposed by a coalition of 50 community and civil rights groups. The list is largely a docket of best police practices, such as "the first priority shall be preservation of human life" and "excessive force and other forms of police misconduct will not be tolerated." In general, protesters have agreed to peaceful demonstrations if police don’t interfere, while police have agreed to respect demonstrators' right to assemble as long as there is no violence.

Negotiations on Tuesday continued to stall, however, over seven of the proposals, including the coalition's request to give protesters 48 hours' notice prior to the grand jury announcement.

(KMOV.com) – St. Louis County Police said they arrested 31 people for burglary, theft, and receiving stolen property the week after Michael Brown was shot and killed.
